Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
i have sent my request for charges back for 2 accounts one is for £1264 the other is £2772 i have got a letter back saying sorry you are not happy with the charges been applied to your account and they believe them to be fair and reasonable so i have sent another letter saying that i give them another 7 days to refund or i will take them to the small claims court is that all i can do does anyone think that they will pay up or will i have to go to court i dont really want to but i will if i have to i also have a loan with RBS wich i have never defaulted on but i am a bit worried they may close my account can i use this as a bargening tool for them not to close my account as i will not be able to pay it back to them if they close my account i will say
Your next letter should be a letter before action (lba) which you can find here in the bank temps library folder.
You should give them a further 14 days not 7.
However if they reply within those 14 days to say they arent paying.........then you can start the court proceedings.
They may tell you they are going to close your account if you are running up charges later.
This is something that goes with the risk of claiming.
Dont bargain with them............just claim what you are entitled to.
hope this answers your questions
