    Default Capital One PPI Claim

    Hi All,

    I have started a PPIicon claim against Capital Oneicon, of whom I applied for a card in 2000 and been an account holder since 2000.

    I recieved the following letter and details back, to be honest I dont know what to do next.

    On the form it clearly shows that I am a student NOT in full time employment so I would not be able to claim on the policy anyway.

    Could someone please help me with my next steps towards Capital One?

    sorry but the thumbnails you posted are to small to read even using a magnifier can you enlarge the images?


    If you were a student at the time the loan was taken you should reclaim the PPIicon as mis-sold. Please read these links to give you an idea on how to proceed.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

    Alanalana - thanks for your quick response

    So I guess the next step would be a SARicon from Capital One and take it from there. Once I get the SARicon back what would my next steps be?

    The fact that I was a student at the time and on the form they sent back to me had a box ticked that I was a student must go in my favour right?

    Sorry for firing all these questions at you, I am just a bit confused/lost with this all at the moment

    What you state above is correct. The aim of the game is to gather the data through the SAR, decide on your strategy then claim back your money.

    Please though do read the stickies and search through the CAGicon site there is a large mountain of information on this site that will enlighten you.

    Right I have sent of my SARicon today will keep you posted on the progress.

    On the form they sent back to me which was my initial application form, I ticked the box saying I was a student. I wonder if this will be enough to claim for mis selling on the basis that I was a student.

    If this is the case, why do I need a Subject access requesticon?
    Can I not send a counter arguemen letter also staing that because I was a student I disagree with their response that I wasnt mis sold and would like to claim along these lines?

    You are correct you could bang in a straight claim, but the banks are playing games with claimants and cap one is one of them they have just turned down one of my claims.

    So you would be better to have all the data from them before you start to claim.

    Also make sure they supply everything that you ask for and ask for the lot.

    My SAR got a response but there were documents missing, new terms and conditionsicon which were not relevant at the point the card was applied for, missing information, boxes on the application form pre ticked and no evidence to back up the phone callicon when the loan was applied for and the Consumer Credit Agreement was in fact and application form.

    My complaint to the fosicon is going Special delivery tomorrow.

    Capital One have not been playing by the rule book IMO please see this.............
