Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have several creditors pursuing me for debt which I cannot pay due to redundancy and unemployment.
I have been in arrears with Barclaysharks for the past 6 months now, I refuse to speak to them over the phone and have not made any contact via the post, I have not sent a CCA or SAR request.
Today I receive the following DN from Mercers..
Page 1
Page 2
The DN is dated 10th August 2009 with a remedy date of 27th August 2009 although I received it today (13/08/2009)
The envelope has a postage paid stamp on which is 1st class but no stamps to indicate when the letter was posted. I cannot prove that I received the DN today as it was not recorded delivery
Can I please have comments on to its validity I.e are the dates and content in order.

I shall be sending a CCA and a SAR request off in the morning. Going by http://www.consumeractiongroup.co.uk...ml#post2330489 the DN is defective in that it does not allow 14 clear days for remedy and also the OC address is not in the DN.
I hope barclaysharks/mercers terminate on the back of this
Thanks for your input Slick, much appreciated!
Pinny
Pinny,
can you show the letter that you sent mercers about the defective DN, was it legal jargon or straight forward?
thanks
Hi Indebt
I sent in a cca request, I did not mention the defective DN as they have not terminated the account yet, I shall be holding the defective DN as an ACE up my sleeve
