Im just getting to grips with CCA & PPI claims etc. Have had a RBS PPI success so am going through all my partners debts and trying to sort them out and have just reached the HFC one.
History is he brought a PC from PC world possibly 7-8years ago. He says he would have taken the PPI out on it - even though he was self employed and hadnt been working at the time (all very complicated and long story). Anyway he also says that as well as the credit for the PC there was extra credit available - unsure how that works as he has no paperwork grrrr!
What we do have is:
- a statement dated 25.01.2007 thats shows a loan start date of 25.06.2004 for £4800 and payment of £40pm for 120 months and he had been making payments ever since.
- a letter dated 17.06.2009 stating overdue amount of £20. As we are struggling financially the 18th May payment he only paid £20 by bank transfer instead of £40 and he did this again in June and July.
Question is at this point do I send a CCA or an SAR request?

Received letter from HFC today re £60 arrears. States
"You may be served with a Default Notice in accordance with Section 87(1) of the CCA 1974. The cost is £50 and will be added to your balance"
a sort of fire-fighting role here. Hate HFC & their past compulsory PPI ethos

no they dont
just delaying tactics.
sadly HFC are terrible for farting customers around
even read that they deliberately mess with figures on reclaim letters just to stall the customer even further, hoping they will give up.

Thanx - thats what I thought. Should I just reply saying something along the lines of "legally I do not have to provide you with a copy of my signature. Please ensure that the information I requested is sent to me without further delay"

I would also like to draw your attention to the Data Protection Good Practice Note: Checklist for handling requests for personal information (subject access requests) issued by the Information Commissioner’s Office. Section 2 states Do you have enough information to be sure of the requester’s identity? Often you will have no reason to doubt a person’s identity. For example, if a person with whom you have regular contact sends a letter from their known address it may be safe to assume they are who they say they are.

Still awaiting any info from HFC since replying to their identity request.
questions...
1. Does the 40 day still count from when they 1st received request or is it from when I replied to their letter (they have still not cashed chq although their letter of 1st Oct confirms receipt)
2. If no reply within the 40 days is it a straight account in dispute letter and stop payments. As if it is 40 days from original request then we are past that now......

Hi,
Need some advice...again!
Sent SAR as per previous post and got nothing. Sent failure to supply docs letter and got nothing.....What on earth do I do now??
They never cashed the £10 cheque although one of their letters confirmed receipt so they cant say they didnt get it! Just dont know what to do next. Hes still being paying them each month although this month he has only paid £5 as being made redundant so Im expecting a letter from them about that. Just really want to move this forward......

Have today received a letter from HFC stating
"we wrote to you on 1st October 2009 asking for further information in orderfor us to process your request, therefore as we have had no response the file has no been closed. Please find your cheque for £10 enclosed"
Now what do I do??? Obviously, as per previous posts - I have been writing to them. Do I send the cheque back, write a new one and start the process again??? This seems madness.......
