I believe I have a case for unfair relationship test for the following reasons
As soon as I knew I had financial problems I contacted swift and asked for their help as quoted in the agreement and they refused.
They sent letters stating "can we help" but on contacting them they again refused.
After meeting a debt counsellor I decided to try a time order and told swift:
1. I intended to apply for a time order.
2. I would have to stop any payments to them to get a default letter.
Even though I had kept them informed they continued to treat me as if I hadn't spoke to them and sent me charges [as per agreement]
Even though I spoke to them each time they charged £250 and directed me to "Eastern Counseling Agency" which is not a seperate company but is swift.
Eastern did not offer any help as pretended in the title but actually sent me the same default charges and refused to offer any help.
Although I have now won the time order I find that the punative charges applied by swift [which I believe are designed to stop me from going for a time order] have added thousands to the debt. I also have been charged their solicitors fees for court representation even though if they had helped a little it could all have been avoided. I couldn't raise the money for my own representation in court.
I can't afford to go to court again unless I am guaranteed success.
Any advise out there?
You have posted Swift's routine so well. I would say most of us Swifters on this site have been where you are now. I notice it is now 16th August and no more replies on your thread. It is poss you have been pm'd by someone to help you but I will pass on your dilemma to those in the know.
Hi, I would appreciate any help I can get but nothing so far. I have just found a letter from Swift which offers help if I contact them. When i did they refused all help and stuck me with their internal company eastern counselling agency which claims to be debt managenet but really are just an excuse to add a £250 charge.
Forgot to mention my other thread which detailed the interest rates quoted by swift. I'm hoping someone can put bones on them for mr as I believe they are guilding the lily. If any accountant can help please do.
JML, have you looked at the thread link at the bottom of this page yet? I would start from page one but do know there are many posts on there to catch up on, but worth it. I've asked for assistance for you.
