After reading this site for a long time, have finally decided to take the plunge and post. I'm trying to claim back charges from a Lloyds TSB Credit Card account (so I hope I am posting in the right section). Asked for the statements way back in March this year, finally received some on 5 July (August 2002 to March 2006) with a letter saying the rest would be with me in due course. I rang the office today and was told they had no record of statements prior to August 2002 (not just mine apparently but everyones?). Has anyone else out there been told this? I seem to have been waiting forever and now want to just go ahead with the statements I have? Any advice would be really appreciated.
You have been waiting a long time..... you could always begin with your prelim letters for the amount you have the statements for and estimate an amount for the two years you don't know ???

Just to update on my missing statements. Found some email addresses on this site for Lloyds TSB and sent an email to them all, asking for an explanation re my statements. Got a phone call from TSB and was told there had been no activity on my account previous to August 2002, hence no statements dated before that. But they are wrong, and I got my bank statements out and there were payments to TSB before August 2002, and the first statement I have from them gives a balance of approx £1000, a payment of £40 and a late payment charge of £18? Obviously if there was no activity on my account before that date, then where did that balance come from? In all fairness, the girl I spoke to was actually very nice and agreed that there must be more statements, and has promised to get back onto that department and try to sort this out for me asap. Have decided to wait until Friday, if no response by then, I am just going ahead with the statements I have and an estimate for the rest.

Hi Bettyboop, in June 2006 I received Lloyds TSB credit card statements back to September 2000 - my thread for this is Bean's Timeline (MasterCard).
Also, when speaking to Capital One, one of their staff was able to tell me the total number of charges and the cost per item prior to Capital One sending a reply to my Data Protection Act Subject access request. This gave me an accurate total for charges to claim in my Preliminary Approach for Payment letter {but I will have to notify the exact figure for credit card interest on those charges when I receive my DPA(SAR) info}. What I am suggesting is that you might phone LTSB and find someone who can tell you what the total is, and perhaps ask when the charges occurred, even though they are not giving you the statements for 2000-2002. Thanks for your help. Its really frustrating because I have been trying to get my statements off them since March. This time though after speaking with a member of their more senior staff, I am hopeful of finally getting the rest of them. However, I definitely am going ahead and including an estimate for the missing statements if no information is forthcoming by this Friday. They do tend to be giving me the runaround! Another call from Lloyds TSB today (Wednesday). If the statements haven't been sent by around 23 August ring them back and they will get onto their archive department again (they are supposed to be chasing them up at the moment). Had enough. Preliminary Request for payment sent today - can always amend figures if missing statements ever arrive.

Thanks. I hadn't noticed that thread before (wish I had). I probably should have sent this long ago, but Im afraid I let them string me along. Everytime I rang, 'they'll be with you shortly etc'. I have kept all the letters (dating back to March 2006) promising they would be with me at the earliest, taking longer than anticipated etc. I am hoping that these will be enough evidence to prove that I have really tried my best to get the statements, and they have just been obstructive (right down to telling me last week there were no more for me!). Do you think I should send the template letter anyway but just go ahead with the court claim. I am getting tired hanging around waiting for them and I almost feel like giving up on it (Ive had the same problems with cap one)? Story of my life - always more complicated than it needs to be lol

Yes.
If you have to amend your county court claim figure, you can do that and add the cost of the amendment (I may be mistaken, but think it's £35) to your claim. Check on how and when you can make an amendment, and what it costs, with the court staff / moneyclaim helpline when issuing your claim.

Thanks again Bean. I'll do that. I was just reading your last post on your TSB thread. You really do have a way with words in those letters and I admire you for your courage. I prob shouldn't admit this on here but I would have been very tempted to accept the offer. You deserve to win and I'm sure with letters like that you will. Brilliant job!
