    Default Personal Investment Authority Regulation

    I am in the process of fighting M & S to repay my PPIicon & they are trying to wriggle out of it by saying that they were not regulates by the GISC.

    On checking the FSA register I have found that they were regulated by the Personal Investment Authority which was taken over by the FSA in 2001 when I took out my card account.

    Does this mean that I can now take my complaint to fosicon?

    Marks and Spencer on checking the FSA register seem to have been under the FSA regulations since 01/12/2001 so if you agreement was with them after that date then the FSA would be the authority and therefore the FOS may be able to deal with a claim for misselling but check this out and ask for advice...

    PPI is a very complicated issue but the FOS are very helpful and if you give them a call they will offer advice on whether they can look at your claim.. here is the link to the FOS site.......

    A lot of companies banks etc are trying to avoid the PPI issue by claiming they were not regulated at the time, Sadly this seems to be the case as they were self regulating. When banks self regulate they tend to take their customers to the cleaners in a lot of alleged cases.

    I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
