    Default Rejecting Car - Advice appreciated

    Morning to all

    Hopefully you could advise clarify my rights, as they are quoting me from trading standards what I'm entitled too. I recently purchase a 2003 SL55 with 30k miles on from a prestige independant garage for £30000 (actually a px of £9750 and the balance on my debit card). On picking up the car there was very little petrol in, though thought nothing of it (plus the car was dirty inside despite having been delayed on being able to collect due to apparently the car been valeted) As soon as I arrived home with the car having now filled with petrol there was a very loud knocking from the fuel tank, which in turn is acommon fault with the fuel tank baffles and is a £3000 repair. Furthermore the second keyless go has not been programmed, the engine check light has come on...oh and the drivers seat bolster was worn (obviously I discovered this on viewing) though the advert quoted 'as new throughout' I contacted them straight away, and they assured me they new nothing off this and would sort it straight away and send a transporter to collect and drop me off a courtesy car. They did come and collect, albeit to drive it away not a transporter' and left me a diesel car instead, not quite toe summer convertible I had just paid for. They have now had the car for just over 2 weeks, and on my latest call I have been told they have just ordered a part, as they where trying to seek a warranty claim through mercedes. I buy now am sick of the car, expecting for that money to have a car that was trouble free..at least for a day, and as they have had the car for over 2 weeks I think they have had long enough to repair, hence stated I now wish to reject the car under the sale of goods act for a full refund. They went away and have now told me they are entitled to 3 weeks to repair the car (though I can not see they would manage this deadline anyway) or to offer a replacement. As I now have no trust in them at all am I not entitled to have my money refeunded, as previously mentioned they currently have the car...any advice much appreciated..it just shows don't trust high end dealers, I have bought cars privately for years and never had any trouble, i pay this much and think it would be safer to go to a dealer and this happens!!

    Its not what they WANT to do mate, its what YOU want them to do. Have a look here: Used cars - consumer rights as this has helped me form the basis of my rejection/reparation claim on a purchased car.

    If you told them in the first instance to repair it, then they've ticked the boxes by offering you a temporary motor to drive round in. They're allowed a 'reasonable' time in which to repair it. Find out how many labour hours it would take and form your own judgement.

    You can still reject the car after the repair, if the repair is not 'satisfactory' - but again, this is semi open to interpretation.

    It would be your choice to accept a replacement after this stage, or then request a refund.

    Thanks for the link, and your reply, I have given them a final time frame of 1 week since my reply to have the car fully repaired and returned, so will see what happens then before persuing any further..fingers crossed!!
