    Default Can I claim on a joint loan if other is bankrupt

    Hi all,

    Can I claim back money for a missold PPIicon policy on a joint loan, if the other named is now bankrupt? And will this go towards the balance of the loan or be given to me. The loan is still current. Also would the other named have to sign as its in joint names yet I have no contact with him.

    oohhhh, this is a tricky one
    I don't know anything about bankrupcy, but from what I gather, you could reclaim for a missold PPIicon, I think you would have to do it as a joint signatureicon though, although don't quote me on that. I guess you would get your share of any repayment, but the bankrupt person would need to pay his share to their bankrupcy.

    A bit of a weird one this.
    I would maybe go ahead and send off your SARicon with just your name and see what happens and in the meantime wait and see if anyone has any more informed advice.

    The only thing I can suggest here is to contact the fosicon and seek some advice. The reason I say this is I have recently requested information on Loans and the company have responded by requesting the authorisation from the joint account holder. In my case this has been possible but if in your case it is not then you need further advice on how to proceed.

    I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
