After making a CCA request to Egg i have received a copy of an agreement back (it was a few days late but i guess i can't old that against them!!) that appears to be valid. I just have a couple of points that i would like to query before i decide whether or not to put the account in dispute.
1) The prescribed terms are included but on a totally separate page from my signature and date etc.. I really can't remember if the first page ever existed or not but assuming it did is there anything in the CCA regarding whether the prescribed terms, repayment amounts etc should be on the same page as the signature? Is it a valid reason for a dispute?
2) The agreement they have sent me states that the repayment schedule is over 60 months and is £300 per month therefore ending in 2010. The actual loan account, after a repayment holiday (2 years ago) and a renegotiation over the phone (2 years ago) ends in 2013 and is £24o per month. They haven't sent an agreement with these figures on. Is this a valid reason for a dispute?
