    Default Tilly V Smile

    My claim with Smile started on 15th June 2006 when I sent my DPA letter. I finally got my statements on 18th July 2006.

    Letter requesting refund was sent recorded delivery on 19th July 2006
    Received a response saying it was being looked into on 24th July 2006
    14 days was up yesterday and I tried phoning and got fobbed off left right and centre.
    Sent lbaicon letter recorded delivery yesterday and received a phone callicon this morning from a patronising a**ehole in the complaints department who told me that they have 8 weeks to deal with the claim and it wont be looked at until the 21st August at the earliest - apparantly they are very busy . Anyway I told him that this was not good enough and that they have 14 days to comply with my letter before I issued court proceedings and they would have to incur the court costs added to my claim. He told me i wouldnt get the court costs back (yeah right!!!!!) He then told me to go ahead and take them to court in an 'i dont give a damn' attitude!!!! Okay then mate I will (after the fourteen days obviously) This man obviously didnt like dealing with a woman either. He asked on various occasions to speak to my husband and wouldnt deal with me. The account is a joint account??????

    What is it with these banks now!!! I was told by one member of staff that she wished that customers would not try and get them to work on given timescales . Sorry but thats what they do to us!!!

    Rant over - wish me luck - I need a new boiler and this 610 quid could really ease the pain!!!

    Sound like you have the right attitude here !

    Keep at 'em. Don't be put off. I wouldnt bother phoning personally - never seems to get you far.

    Best of luck with the claim - although you won't need it !

    Just logged onto my bank and noticed that I had a secure message from 'manager' sent today. I said :-

    Hello Mrs Larke

    I'm sorry about the delay in replying to you.

    I can see that you've spoken to my colleague Nick regarding this matter. As he confirmed during your conversation we will review your complaint and issue a response by August 21st.

    I'm sorry if you feel it's necessary to pursue this matter further before that time.
