Filed my claim online on 1st August. Showing online as issued yesterday. Got a letter this morning saying that my claim had been sent to the defendant by first class post yesterday. Am I right in thinking that the claim is deemed to be served 2 days after posting? As on this notice of issue letter it says the claim will be deemed to be served on 7th August (Monday) - surely it should be tomorrow (Friday 4th), 2 days after the court posted it?
This should not be seen as concrete. Halifax are likely to send an acknowledgement of service quite quickly.
Their recent patterns suggest they are dealing with acknowledgement straight away.
In my own case claim was issued online on 27th and Halifax acknowledged on 28th.
Dont forget they are doing this stuff electronically !!
There is a recent case in there being only 5 days between issuing and them settling.
They will submit that they are defending and require the 28 days but recent cases show they are settling in some cases 2 days after their acknowledgement.
Dont worry then it will be soon.
Incidentally keep a check on your account if its still live.......they are just paying straight into that.

Thanks Martin. Just called MCOL and they said they allow 5 days from the date issued hence 7th August. Halifax should have received it today anyway Am checking my account already lol.
