Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I sent my Data Access Request letter and according to royal mail Egg recieved it on 17/07/2006, (the same day as i also sent to First Direct).
I read a few of the posts here that Egg were sending out letters to get proof of ID. So i thought to save Egg sending me one of these I sent a copy of my passport along with the letter.
Suprise suprise, I got a letter from Egg yesterday asking for proof of ID, in the form of a utility bill or the like. So apparently my passport does not prove my identity, but a gas bill does!?? :? . They also reckon that the 40 days starts from when they receive this ID!!, errrr...I dont think so!
So decided to send a message through eggs secure messaging system.
Stating that i already sent a copy of my passport to them which should be sufficient and along with the message through their own "Secure" messaging system should further prove I am who I say I am (otherwise secure would be pointless).
I then pointed out that the 40 days began from the day they recieved my original letter.
Will keep you guys posted on Eggs antics.
I don't think Egg were prepared for this at all.
On a different note, First Direct to whom I sent the letter on the same day. Have already returned my cheques, received my statements through DHL courier and I have sent off my letter to claim charges back!!
Surprised they didn't ask you to jump through some hoops too.
The date starts from when they receive a valid request with fee, and your's looks valid to me.

It's ridiculous; any bank/building society will tell you, when you are proving your identity and address as a new customer, that utility bills prove address only, NOT identity, that it is indeed a passport or such like that proves identity.
I think everyone provides the ID just to stop the stalling tatics but it would be nice if someone actually challenged it though Court claim. It would seem reasonable that secure messaging and passport ought to be enough and other companies don't need it so why are Egg different ! Oh yer I remember the OFT told them they were now they think it's approval to do what they like. They need bringing down to earth ! Fast.
Egg Data Protection Act Statements arrived. On hold.
Halifax - Moneyclaim £3100
Amex to Remove Default - acknowledged didn't issue correct documents - default removed . £135 paid in full without Court
I think that they are using criteria set up by others to ascertain identity.
To open a Bank account you need to supply evidence of your name and evidence of your address, and they ask that these should be from the following list.
Passport
Drivers licence
Medical Card
Pension or benefits order book
Birth Certificate
In the case of proving address
A utility bill
Bank statements
Rent card
plus more.
Makes you laugh as evidence of where you live can be shown since you got their letter sent there in the first place and if you are wishing to make a claim against them why would you be using any address other than your own ?
They of course hide behind the data protection act sec 7. 3a which gives them some scope to refuse to release if they are not satisfied with id criteria.
Message is then, always send the 2 proofs in the first instance so they cannot use this arguement later.

Egg acknowledged my secure message and said they will send my information to me now. But they keep trying to set the start of the 40 days to when they reply to me. So have messaged them again just a polite reminder that the 40 days started when they received my orginal request.
To top all this...Egg have cashed my £10 cheque (which is fair enough), but LloydTSB have cashed it for £1000, not £10. AND!! now no one will answer customer service phone, so will have to take a long lunch and sort it out so i have some money!!!
AAARRRRGGGGHHHHH
