Hi. A couple of years ago we moved house and the only address we forgot to change was our car registration. We only realised a few months ago and changed it as soon as we could. Shortly after updating our address, I received a Final demand from a bailiff stating that they would seize our goods if an amount of £500 wasnt paid within a couple of days. I immediately tried to find out what it was related to and it turned out to be a moving violation ticket. We obviously never received the fine or the subsequent debt collection letters as they were being sent to our previous address. I paid the amount in full as it was the only way to stop the bailiff clamping our car and then I submitted a Statutory Declaration / Witness Statement out of time and explained the situation.
I received notice yesterday (06-July-09) that my application was refused, but I can request a review of this under rule 75.5 (2). However I have to apply under rule 23.3 within 7 days from the date the order is drawn - which is today!
I tried to look this all up but its pretty confusing. I think I have to submit form N244 but Im not sure how to go about completing the form. Also, it sounds like I have to pay a fee, but Im not sure how much? Finally I cant believe it took 6 days to get to me leaving me only 1 day to submit my request.
Is it worth trying to get this form in? How much do I have to pay and is it worth it?
