    Default wewonitfivetimes v NatWest

    Hi guys

Just sent off my prelim letter claiming back over £450 in charges for a Natwesticon society account on behalf of my sunday football club.
Anything I need to do different here?? (am also claiming against Woolwich personally for over £1700 in charges!)

    Thanks

Yes, get your lbaicon letter ready to go and then start thinking about what to put on the Court papers. Natwesticon seem to be zipping along at the moment.

I sent my first letter 17th July, then an LBA, then issued a MCOL claim, and today (3rd August) NW have filed a defence. I don't know whether this speed is good or bad, but at least it will all be over with quicker!

its not good when they file a defense but this is what they do, its rare that Natwesticon pay before this point. It just means they are showing to defend the claim. They have so far always paid out before the court date.

My advice is only my opinion, I am not a legal expert.

Well, in my case they filed a defence (said to the court they were going to dispute my claim) on Tuesday ........ and on the same day also wrote me a registered letter I was very pleased to receive. It's all over now!

    Yes, you are right

Your lbaicon should only include overdrafticon interest on your charges (if you can be bothered to work it out) .

Need some guidance guys!! - please.

Had my reply from dear Mr Higley saying nothing else to add and informing litigation.
Quick reply and well within the 14 days given.
Presume that I can now go to MCOL now ?? dont still need to wait until 14 days are up?

Just checking as well. Total I claim is charges + interesticon + 8% - what about my claim fee? - does this just get added back on if i win?

Any other help or guidance or links to assist will be gratefully received

    Thankyou !!!

Hi, It does get added on. I went through MCOL on the 12th, they filed a defence on the 12th, so they have til the 12th October to pay up. I bet they make me fill in the aqicon though, but stick to your guns and templates.
You can go through MCOL now, it seems that Natwesticon are the hardest nuts to crack, my others halfs has just offerd him some money, way below what we are claiming for, but it looks like an admission of guilt to me, whereas natwest are digging there heals in and hoping that they can scare people.
Good luck, I will look out for your thread and help when ever I can

    Great help, many thanks,
Will file with MCOL now then. only claiming £454 for my football club account so hoping they will think that it is too much hassle/costs to go through with it and will offer a reasonable settlement.
Got an offer with my Woolwich of just under half the amount claimed but asked them very nicely to settle at 85% or i will proceed with claim for full amount.
As the Woolwich/Barclaysicon seem to also be one of the slowest and toughest I thought it was worth a chance as i would be happy with that.
You never know but Im not holding my breath!!

    Thanks again
Will keep you posted and look out for your updates as well.

Hi, I am very surprised that they have not paid out, with it being a small amount ! But hey who knows what goes on. 85% if you are happy with that go for it, you are not being unreasonable. Like I said my B/F account offered him £300 squid less, but it was too late we had already filed MCOL the day before, if we had being offered that the previous week, we most probably of taken it.
I do appreciate the pressure that they are under, but we gave them nearly a month before we went through MCOL due to lack of funds !! Makes you wonder if they are keeping tabs on your account, to check that you cant afford going through with it before they offer you the once and only EVER offer????
