Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I recently made a F&F offer to M&S Money - i have CCA'd them and they sent me back a full CCA etc. So i made them an offer - along with a number of other creditors at the same time of about 20%. My father in law has offered me a small loan in the hope of getting some F&F accepted and paid off etc.
So far M&S Money are the only ones that have replied - with a nice letter but saying that they cannot accept my offer but may accept 80% of the debt. There is no way i can pay that at all... So what would anyone's advice be to do now on M&S? I am paying them £1 a month at the moment - have no income apart from benefits and am over 8 months pregnant...
Write back & tell them that you are unable to pay more than £1.00 a month as you only have benefits income, that you are unlikely to be able to work in the foreseeable future due to imminent child & cannot therefore see that you will be able to increase this amount any time soon. However a relative is prepared to loan you a small sum to offer F&Fs to your creditors on condition that the sum offered is accepted as full payment of your debt with the CC, if it's not you will have to withdraw the offer.
If you can also increase your offer to 50%, they may then go for it. Unfortunately 20% is not usually sufficient to strike a deal when there is a valid CCA in place as they think they will eventually receive the total owed, even if it takes years.

Hi, Just wanted to say thanks for the advice. I am no further along... I can't raise any more funds at the moment so not sure what to do. I will keep you posted. Thanks again.
