Hi - I won't go into all the detail (as there's a lot) but here's some of the basics:
My wife had to go through a grievanceprocedure when returning to work (due to unfair contract changes), after AML (Additional Maternity Leave) for our first child; her boss is the MD and thus the grievance was against him. After appeals and negotiation they reached agreement - my wife loves the job and was keen to return.
That was about 1yr ago. Earlier this year she informed her Employer of another pregnancy and within 24hrs was told that her performance was "crap". She told them of the preg. early so as that the Company could make alternative arrangements, and avoid unnecessary costs for forthcoming activities and events. After other examples of poor behaviour/attitude toward her she raised a grievance. My wife is not a trouble maker, just wants to get on with the job she loves. This has resulted in an IT, the deadline for the Employer to respond has now passed - I understand that the IT will now make an uncontested judgement. Is this really the case or will they wait 1-2wks just in case the company does respond?
Also in the intervening time, and to confuse/complicate matters, my wife has been made redundant. She had a ridiculous consultation process and has yet to go to appeal. However the company informed members of staff that my wife was redundant before she had written notification, and also before any appeal has been heard!
Has anyone any thoughts on what may happen? The solicitor has indicated that the two cases will be combined by the IT (my wife won't back down on the redundancy either) but as they've not responded to the first what is likely to happen?
Aside from procedural errors there's a strong case of discrimination. I think that the company has taken advantage of the fact that we, unfortunately, lost the 2nd baby - they didn't like the fact that she could retain her Co. car for the normal maternity leave period (6month) first time around. This is now 12months and I think that now she's not pregnant they can ease her out of the door, knowing that we'll be trying for another child soon.
