can i stop mm taking my car i owe them £2300 i have not re newed the agreement and ive just gone bankrupt they have spoken to the powers that b and he says its there car and not an asset of mine so now there trying to get it they wont come to any other agreement to repay apart from giving me a letter to say they wont sell it for a month to give me chance to get the money i owe. i took out an original loan of £2000 in 2007 we have paid back around £5/6thousand ive checked the bill of sale and it was registered in 2007 and 2008 . is there a solicitor that i can use or any1 but i need them to b free of charge as i dont have any money and im unemployed as is my wife

Hide the car so they can't tow it away. If they try and enforce the debt through the county court (unlikely due to amount you have already repaid) the judge will possibly rule in your favour.
When i say hide. Don't put it in your garage, on your drive etc. The clamping team mobile money send out will drive around the area you live in searching for it, after knocking on your door. They will call very early in the morning 6-7 and usually late in the evening (also weekends). (i.e when you are not at work). Don't answer the door if they knock, they have no powers to enter your premises as they are not employed by the county court. Ignore them till they go away, they may shout threats through your letterbox, again ignore them. If i were in your position i would keep it at least 3miles from your current residence. Also judging by the amount of loan you received from them i would assume your vehicle is worth a few thousand. This will ensure they will continually look for your car. I've hidden an old car of mine from them for over 6mths now. But im fortunate as i keep it in my parents locked garage about 400m from where i live.
ty 4 that riddick i have got the car hidden i have a friend who has let me have the use of the garage at his place so no probs there . they did call last nite n speak to the wife offering her a deal, but she told em no chance .they wanted the car at their depot but i could keep the keys and they would give me a letter saying they wouldnt sell it . id be happier saying heres the key ill keep the car then were both losing until its resolved.
They would just change the locks (does'nt cost much). Be careful if they know where you work as i believe before i got my new car, they turned up one day.
im having probs with mobile money too,my car got stolen my ins company wrote it off but have also said there is outstanding finance {mobile money} that has to be paid before i can receive any money,,its not leaving me enough to buy a pushbike let alone a 7 seater{ive 4 kids},,any advice please?
I think you are out of luck here.Your insurance company will pay the Creditor prior to you receiving any money due. I would contact MM and ask them what the outstanding sum owed on the vehicle is. (MM charge 10% interest per month). If you settle the loan early then there is no need to pay all of the interest. I would get MM to e mail you the outstanding sum or even pop into their local office and get a letter from them and fax/send this to your insurance company. The reason for this is that when the insurance company do a HP search on the car it may list the total outstanding finance on the vehicle and not the amount owed if it is settled early. (im 80% certain im right). Good luck!
mobile money have said that the settlement figure is £870 but the loan isnt due to end till oct,,,im waiting for trading standards to check my bill of sale but if its found to be void will my ins company still have to pay them first?
UPDATE: ive seen a solicitor and my BOS is totally unenforcable.therefore even though i still owe them the money they got to remove the marker on my car,then take me to court or whatever for their money.
