    Default Phone Call with Barclaycard

    I just spoke to a nice chap to inform him I'd initiated a claim and eventually he actually told me of all the charges made against the account so I now have a figure to work with...Not sure if this is news or olds but it's certainly damn frustrating since I used an estimation for my claim only yesterday!!!

    Hi Tobes,

    As you have helpfully contributed to my Capital Oneicon thread "Bean's Timeline (Capital One)", you will know that in a telephone conversation with a bank representative I was given the total number of charges levied on my account and the cost per item. I therefore had a total on which to base my Preliminary Approach for Repayment letter prior to receiving a reply to my Data Protection Act Subject access requesticon. Of course I did not get the dates the charges were applied so could not be specific about the credit card interesticon but simply said I expected to notify it later when in receipt of full data.

    I note this here for the benefit of others, i.e. that it is possible with some departments (of Capital One, not sure if it applies all banks...) to obtain the total of charges over the phone. This could prove a useful starting point for PAR and lbaicon letters where the microfiche arguement is being used. Personally, I would not wish to initiate legal proceedings without first being in full possession of the facts, but this does seem to be a way of establishing a reasonable basis.

    I should also point out that Capital One were not holding back any information for any reason - I am awaiting a reply to my Data Protection Act Subject access requesticon by 15 August 2006 and fully expect to receive it by then.
