Last Friday i received a telephone call form the neanderthols at AIC debt collectors. I took out a bank loan back in 2006 from Natwest and I have always paid the re-payments up until the last 12 months, where I have found it difficult and hard to keep up the repayments. I arranged with the bank a re-payment paln of £ 50 per month, which has been leaving my acount religiously on the 4th of every month.
Now 2 saturdays ago, I rang the bank and asked them to forward me a copy of my original credit agreement and to see how much was outstanding on the loan aco****, I requested my credit agreement, cos I had learnt about the loan not being enforceable if it was taken out pre april 2007. The girl I spoke to was nice and tld me the balance was £ 15800.00 and she said she would forward me a copy of the agreement, as of yet I am still to receive! I got this nasty phone call from a Mr Watson at AIc demanding I pay the outstanding amount, not the 15k but half that with his 50 percent discount and needed to pay £ 7587.00 as soon as possible. I informed him that it was impossible for me to raise that cash and he asked me to get a loan adn ask embers of my family, which I was not doing. he then asked me to call him back last Friday to let him know where I was upto, and obviously I rang around a few loan copies to get laons and stuf, but I thought why wud the bank accept 50% of my loan, hence me asking for some help!!
I never rang the man back last friday an dhave today recieved a recorded message from AIC on my telephoen asking me to ring them quoting me reference number which I am yet today. I am scared and dont know which way to turn and need to assistance form someone - HELP please!
I did however receive a little slip of paper asking me to contact this man adn the office number on Monday this week but I dont know wat to do and need to know if they can do this to me and to know what to do next - I have however employed Beneficial CLaims to have a look at the debt being unenforceable.
AIC are idiots. My experience tells me that they are inbred, greedy dolts.
Scan a copy of the original agreement if you still have it to hand, and make sure to block out all personal details, barcodes and reference numbers beforehand.
Then, post the scanned copy here (photobucket is a good program to use for this), then we'll give you our opinion if the original is enforceable or not.
If they can't supply a copy of it by means of a CCA request (templates library for this), their right to continue any further involvement is nil.
What AIC will do is fail, but they'll try it on all the same.
They'll try to pocket the one-pound statuatory payment, will try to use to bring down the outstanding balance that they can't substantiate, and then, that leaves you open to instigate complaints with the OFT and the Ombudsman Service.
Send recorded with a £1.00 Postal Order and don't sign it.
You really need things in writing, phone calls are always a bit dodgy.
Once you receive your CCA, post it up on this thread so people can have a look and tell you if it's enforceable or not.

One more thing. DO NOT SPEAK TO THEM ON THE PHONE UNLESS YOU HAVE THE MEANS FOR RECORDING THE CALL!
AIC aren't just dolts - they are lying, unpleasant and brash dolts to boot, and use threats to put the frighteners on people.
If they do send you an agreement, see how it compares with the one you have.
If the agreement is unenforceable and contains a number of faults that rule out any possibility of it being judged as enforceable, then NO agency (or the original creditor) can take adverse action against you.
Good old threat monkey Mr Watson strikes again!. This fella must be the toughest guy ever over the phone. Had loads of calls of this idiot and yes he starts throwing his toys out of his pram if you do not agree to his lame threats. IMHO ignore his threats until you receive the paperwork you have asked for, also make your request in writing with the appropriate fee enclosed.

Mr Watson, yes he does have little temper tantrums if you don't play the game he's trying to fool you into playing! I asked to speak to his manager after he threatened to have me blacklisted because I wasn't going to pay 50% of the debt I have outstanding.... I got Mr. Brown! Who also fails to play nicely when he's not getting his own way!
