    Default Error of Police document for NIP

    I received an NIP for Careless Driving after driving through a village in a 30 limit (no Police in sight - but I was later forced to the side of the road by a resident and reported to the Police I assume (?!)).

    I replied to the NIP to confirm I was driving.

    I've now had a request from Police to present, MOT, Insurance and Licence, but the vehicle they refer to has a typoicon in the reg no. (Clerical error?)

    I've got 7 days to respond - do I ignore it cause it's not my car, point out their error or what?

    Advice please. Thanks

    They obviously got the right reg. no. at some point, or the NIP would not have been sent to you.

    You must comply with the "producer" within 7 days; after that it's up to them to try and get sufficient evidence to prosecute you. The word of one villager on its own may not be enough, especially if you don't admit to anything.

    An error on the NIP AIUI will be allowed by the court under the slippage rule.

    No it won't because

    a) there does not seem to be an error on the NIP as it reached the OP, and
    b) the OP has completed the s.172 request and admitted being the driver at the time of the offence.

    If the VRM was wrong on the NIP then it should have been ignored for 14 days and then a letter written in response stating that at no time has the recipient ever driven a vehicle with the VRM in the NIP... It is then too late for the Police to issue a new NIP.

    If the VRM is wrong on a producer, then the OP will have to convince the desk officer of this as the documents being produced will not match the producer

    There wasn't an error on the NIP (which I confirmed I was driving at the time of the alleged offence).

    There is an error in the VRM on the letter requesteding

    Yes.

    Simply write back and state that you have no knowledge of any vehicle with the stated VRM, could they confirm that they mean your VRM.

    That way, you come across as helpful and anyway, the whole thing will probably end up a NFA

    I would be interested to know just how you were forced to stop at the side of the road by a civilian with no authority whatsoever to stop traffic.

    Nice letter from the Police this am.

    ".......our enquiries have been completed. No further action will be taken on the evidence available and the Notice of Intended prosecution os withdrawn".

    Is it just me???

    FORCED TO THE SIDE OF THE ROAD by a resident? How exactly? Were they in a car? What is it that they claim you were doing? Speeding? Wheel spins? Donuts? What?

    I think more information here will help us to help you. The mis-spell in a document will be not relevant AFAIK. What is relevant is the precise circumstances.

    So, in YOUR opinion what happened? Then in the local yokel's opinion what happened?
