    Default SAR replies just back from HBOS & Tesco - no mention of the PPI though!

    Hi everyone,

    You guys advised me ages ago to submit an SARicon to HBOSicon and Tesco Loans on a matter of me having paid the Total mortgage Protection plan Insurance (to Halifax) and for PPIicon for a Tesco Loan. I was supposed to be covered for critical illness and loss of employment, but when I suffered both and made a claim I was rejected.

    I won't go into the details - as it's quite long, but HBOS just sent me back a mass of paper work - none of which I can see refers to the mortgageicon Protection Plan insurance or my claims when I became ill and subsequently loss my job. Same with Tesco, they in fact sent me one bank statement and a contract for a £10k loan paid off ages ago - but no mention of the PPI that was charged for it. There was no mention of the £25k loan which I took out after paying of the £10k loan - and again no mention of the PPI or the transcripts of phonecalls between myself and their insurance staff in which I categorically asked about whether I would be covered if I loss my employment or became seriously ill that I wouldn't be able to work.

    I'm hoping you can tell me what I can do now... I paid their £10 fee, and they were slightly later than the 40 days allotted on replying. HBOS overwhelmed me with tons of paperwork, but managed to leave out the most important stuff on the insurance premiums and the subsequent claim. There was no record of my emails to them, or the phonecalls I made, the letters from the doctors who were treating me... nothing at all.

    Tesco did the opposite and sent next to nothing - outrageous that they need 40+ days to do that. I used to have a tesco credit card as well, but they didn't include that in the paperwork either. I'm more interested in the PPI stuff, but both organisations left that stuff out.

    What's my next step?

    Firstly write back and send a letter of non compliance in regard to your SARicon.

    Then submit a serious formal complaint to the Information Commissioners Office links here....

    I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
