Asda CCard / GE Money - No response to letter asking to write debt off
My uncle has an ASDA credit card managed by GE Money. He is out of work and now cannot meet his repayments.
I sent them a budget planner and a letter from the site explaining his financial situation and advising he is unable to make any payments and basically asked them to wrotethe debt off.
This letter was sent end of May via recorded post & has been signed for but todate he has not had any response, should I follow this up or wait to hear from them or is there a template letter to send next?

There isn't a template letter for this. I would just write and remind them. You could also ask for a copy of the executed agreement under s78 of the Consumer Credit Act 1974. THis will cost £1 - send them a PO not a cheque. Remind them that they have 12 days to comply with the request.

Thank you for your reply / advice. We already requested a CCA from them which appears to be enforceable so we were then advised to write & explain my uncles financial situation at present to see if the would be willing to cancel the debt.
We still havent heard so will probably just send a reminder letter as per your suggestion.

**UPDATE** Further Advice Needed Pls
Ok - we have CCA'd ASDA who were able to send an enforceable CCA. My uncle is now unemployed and cannot meet repayments we wrote to them in May 09 {recorded post} asking for the debt to be written off as my uncle had no surplus cash each month to make payments or token payments.
We didnt get a reply so I sent another letter also recorded post and to date still have not had any response or acknowledgement.
My uncle hasnt as yet had threatograms but has been getting his regular statements showing account charges & interest for non payment. What can or should we do next????

**UPDATE**
We sent a further letter to ASDA re asking them to write off the debt due to my uncles circumstances. They have passed the debt on to VIKINg debt collection agency who are now chasing the debt.
I know that ASDA have an enforceable agreement from when we CCA'd them so I presume the best course of action is to write to Viking with a budget planner requesting the debt be written off as unable to make any repayments due to current financial difficulties???
Please advise if this is the best course of action

yes, you could do that. Also, if they have added charges for non (or late) payment, then those charges are unlawful and should be reclaimed as unlawful penalty charges
