I have just been looking at my Experian Credit Report online and hve noticed something odd.
In September 2007 there is a default applied by Hutchison 3G for £132. In April 2009 there is another default applied by Lowell Portfolio for £187. Lowell contacted me in September 2008 and i had orginally disputed the debt but they kept threatening me with court action so i started to pay them £1 per month to get them off my back.
I have been arguing with them lately and maybe that is why they have applied the default.
Are companies allowed to apply 2 defaults for the same account? If not then can i ask for one of the defaults to be removed?
If 3G have sold the debt to Link then Link are allowed to register the default but it must be the same one and accurate. Also their should be a notice of assignment to tell you the debt has been sold.
If they have not sold the debt then the 3G default is the only one that should be on.

What concerns me is the jump from £132 to £187, assuming the contract was terminated, via the default notice, and, I can only guess at this point the contract was terminated, then it appearrs that the lowlife, sorry lowell group have added on charges which it is not entitled to do so virtue of the oft guidlines on debt collection practices
I never got a Default Notice from 3 at all. I did get a Notice of Assignment allegedly from 3 (I am sure Lowell printed it themselves as it has a little dot matrix square and so do the letters from Lowell) along with a letter from Lowell demanding payment.
I did get letters from Wescot starting in November 2007 for the same debt and it was £131.76 they were asking for (I still have the letters) but Lowells letters started asking for £184.80.
