    Default rooftop court date!!

    Hi all,
    I am new to this site and am seeking as much advice as i possible can,

    Heres the story,i'll try not to bore you too much,im 24 and have a mortgageicon with rooftop for almost 3 years,for the last two years i have been on time in paying,but the last year has been a real struggle,i have been in and out of work and have fell behind by almost 6 months.
    Aswell of having the stress from phone callsicon and letters and rooftop charging me extortinate late payment fees and so on,because they seem to charge for everything!!!!!

    I came to an agreement with rooftop in january 2009 to pay an extra £100 for 6 months,on top of my mortgageicon so the total would be £770 odd a month which was ok at the time then 2 months later i fell back out of work again as im self employed.So this meant i broke the agreement so ive only paid twice out of the 6 months.

    So i get a call from rooftop the other day telling me in due in court in august,but didnt really explain to much,nor did i ask what was going on i ended up putting the phone down in a panic.Ive never had anything like this come my way before,and i really dont know what is going to happen if i go to court???? I am going to ring rooftop back tomorrow and see what is going to happen,

    would you think they are trying for repossesion,what would happen if they are planning that???
    Im in abit of a state over it so any knowledge would be very much appreciated.

    mortgageicon lenders are heartless, vicious and nasty. They will repossessicon and they use arrears and repossession as a sanctimonious excuse to extort loads of money from you with the excuse of 'costs' to them and 'penalties'.

    Just look at the video clip below from Oprah Winfrey's Show. It shows just how nasty and ruthless mortgageicon companies are !

    Have you received a summons to court, or was it just a vague telephone threat with no written backup ?

    Have you recieved any court papers yet?

    A telephone callicon stating your in court is not good enough

    Rooftop repossessed my home then sold it for £50,000 less than it was valued at two weeks after the repossession.

    £50,000 less!! are they allowed to do that cant you argue that the place is worth more??
    was you left to pick up the bill for the remaining money owed on the mortgageicon?

    not heard anything from them yet and its a year ago this week. we didn't give them a forwarding address but we are not hiding and are the electrol roll so we are not hard to find. we have only moved just down the road so we pass our old home all the time and the people that bought it got a real bargin, but it don't bother me anymore things had got so bad it was causing problems in our marrage and every penny we earn't went on trying to keep up with their ever increasing payments. I know they went bust just after taking our home so don't no if they will bother chasing for the shortfall but if they do we will go bankrupt so they are not having another payment out of us.
    It was the hardest thing we have ever done and we didn't get nuch support when we was going through it we could have cleared the arrears by borrowing of everyone if we really wanted to but their payments were getting so expensive we still wouldn't have kept up with it, so we decided to let it go and now a year down the line we are renting a nicer house for half the money and have our life back and most of all we are smiling again.

    i have just spoke to rooftop and i have to go to court in august to try and come to an agreement to pay off the arrears on top of the mortgageicon.
    i am £3,500 in arrears and rooftop said that it is not a repo order yet unless i break the terms with the court.
    having said that my 2 year fixed rate of 5.99% expired yesterday and my new rate is 4.26% on a libor rate but wont kick in until august sometime when my payments will drop £200,

    so it looks like i will have to play it by ear in the meantime
