    Default Parking Fine & Baillif's Charges

    Bristow & Sutor
    Hi eveyone,

    I have a situation with bailiffsicon Bristow & Sutor over a parking fine which I was unaware of. They turned up the other day when I was at work and left a note demanding 93.00 I phoned their office and they told me I had to speak to the baillif. I tried his mobile and it was turned off or busy. I have now received another bill from him for 269.78 which is a notice of removal expences and they are broken down as follows:-

    1 man & vehicle 90.00
    VAT 13.50

    Time arrived 9.47
    Time left 9.57
    Estimated return and off load time 12.47
    total time 3 hours

    The notice says it incldes a charge of 144.70 for this visit, my questions are 90+13.50 = 103.50 so where does the additional 41.70 come from? The form is printed full name and he filled it in wth 'Tony' so I cant check him out and can he charge for removing goods when no levyicon has taken place and I havnt even spoken to him?

    My car is on HP and i have only paid 20% off can he clamp it?

    You definitely shouldn't be clamped as you don 't have clear title. However some bailiffsicon will chance it. Make sure you let them know that it is on HP.

    Do you have any reference numbers on the forms? Starting point would be to call Traffic Enforcement Centre (TEC) in Northampton. They should be able to tell you who has claimed against you.

    What you will need to do is make a Statutory Declaration stating that you didn't receive any paperwork. You need to take it to your local county courticon and get signed in front of a clerk. (It will cost you nothing to do it this way). You need to then fax the form to TEC. If the SD is accepted then it sets the process back to the Notice to Owner stage. You have the option at that point to pay up or appeal.

    With regard to the fees bailiffsicon, in these cases, have a scale of charges they can apply.

    It might be worth your while posting a link to this thread in the bailiffsicon form and asking someone there to check the amounts as well as the advice I've posted.

    Finally the council who issued the original notice will send to the "person appearing to the owner". The presumption is that this is the registered keeper. Is your current address the one that is registered with the DVLA?

    Thanks for the info, yes car is registered at same address but unfortunatly I have 2 dogs that like mail hence the bailiffsicon lettr being a littlesmaller than original. How do I keep the baillifs at bay whilst i get the SD sorted any idea how long it takes the TEC to pass info on?
