    Default DPA letter just been typed

    Hi I have just written my Data Protection Act letter to HSBCicon Bank, I will be taking it into the branch along with £10, tomorrow lets see what happens fingers crossed.
    The account is for my daughter she is 18 and being ripped off by HSBC.

    21st June 2006 - Acknowledgement from HSBC
    30th June 2006 - 33 letters arrive - 6yrs statements
    01st July 2006 - Preliminary request for £2868.24.
    12th July 2006 - HSBC offered me £1995, I declined.
    17th July 2006 - LBA sent, now £2970
    01st August 2006 - MCOL for £3778 (inc 8% + fees)
    08th August 2006 - HSBC defending ....
    31st August 2006 - SETTLED IN FULL - Wooooooohoooooo.
    Halifax
    09th June 2006- Data Protection Act Request
    22nd June 2006 - Acknowledgement from Halifax
    08th July 2006 6yrs statements arrive.
    10th July 2006 - Preliminary request for £1393.08.
    21st July 2006 - Halifax offered £115, I declined..
    24th July 2006 - LBA sent, now £1421.
    08th August 2006 - MCOL for £1822 (inc 8% and fees)
    16th August 2006 - SETTLED IN FULL - woooohoooo

    You obviously have the internet so why not get your statements online – see step 3 on this link ....................... Why give them 40 days to earn interesticon on YOUR money.

    hi janet good luck btw when you see that page on left hand side it says transactions and under it says statements if you click on that you will find them the screen you can see is actually the transaction page

    Thanks for the advice just downloaded all the statements now off to the bank with my daughter to see what they have to say I have got the preliminary approach for repayment letter with me along with a schedule of all the charges in case I get no responce from them watch this space. It doesnt come to a lot £188.00 but to an 18 year old girl who has only just come out of college it means a lot to her this has been taken from her over 11 months.

    Default Just got back from HSBC

    Been to the bank we were told they couldnt refund charges (little lie I think), they gave daughter £100 overdrafticon for now to stop the big charges coming out of her account. Handed the letter to recoup charges with schedules of payments got a receipt.

    Default Hsbc Refuse To Pay Back Charges

    Had a letter today from HSBCicon along with copys of terms and conditionsicon saying "We do not agree with your contention that the charges that have been imposed by the Bank constitute a penalty clause and are therefore unenforceable" blah blah blah then thanking me for taking the time to bring my concerns to the banks attention.
    lbaicon letter been delivered to the bank by hand this morning, I made sure I got a receipt for it.
    What do you think will I get anywhere they only owe me £187.00?

    Default LBA Letter

    18 year old daughter had her reply following lbaicon letter they are refusing again to give her her charges back, do we now wait until the 14days are up or do we now start the claim in court?

    The letter states "That if my claim for a refund proceeded to Court, we therefore believe we would successfully resist any legal challenge in relation to these fees. I trust this clarifies the banks position, if you remain unsatisfied by our response i await contact from a third party to prepare and submit our defence".

    Are they just trying to scare me off, and if it went to court would i have to get a solicitor to defend me?

    Don't worry, it's extremely unlikely to go to court. This paragraph is just standard, i've had it in 2 letters from them and they've offered full settlements for both accounts. Just sit tight.... money's on it's way!

    Default Court Action

    Hi I now need to take HSBCicon to court on 25th August as they have refused to pay the money back I have looked around the site but cant find a template of what to write on the form, I have got the N1 claim form from the court office help would be appreciated.

    I have found the N1 template now my query this time is do i put the address of the HSBCicon bank that I have been dealing with on the court papers or do I put head office?
