Scottish Power recieved £250 overpayment, now they wont give it back.
Hello, a question for my friend who has a problem with Scottish Power, she has no internet.
My friend moved into a flat & after 3 months recieved extortionate bill from Scottish power. They were adamant that the bill was correct so not wanting to get into debt trouble my friend spent all her money on this bill.
Now Scottish Power have decided that the bill was infact incorrect & the £350 she paid was £250 more than they needed.
They will not give the overpaid money back & are keeping it as 'credit' on her account. All fine in theory but they are still taking a direct debit out of her account every quarter & not using the £250 they already have towards any of the bills.
I cant understand how this can be acceptable. £250 is a weeks wages, thats alot of money. How can Scottish Power get away with retaining this money that isnt theirs to keep?
Any help on this matter is gratefully recieved.

Contact the bank and cancel the direct debit first thing tomorrow. She can start one up again when the credit is used up if that's how she wants to pay.

Be aware that once you have given a creditor your bank details for a DD, they can set it back up again even after you have cancelled it, I had one do this repeatedly, and my bank advised me that there was nothing I could do to prevent it even though there was no money owing to them. Regarding the credit balance on your account; you are within your rights to demand it back, if the person you speak to refuses to refund, ask for their line manager and be insistent, they cannot refuse to refund the credit - but remember to have an up to date meter reading ready to give them as you will probably be asked for this before any refund is made.
I will never set up a DD again!

It was the 'Nationwide' and I'd be more than happy for you to take up the argument; I went up through several layers of management, although I did get back the bank charge they had slapped on my account as a 'gesture of good will'.

I think you can cancel a DD at any time by writing to your bank. I know I have done it over the counter by filling in a form and not had any problems. I too hate the things and have cancelled most of mine, can't believe I was ever foolish enough to believe that giving other people access to my bank account was a good idea.

It is always best to write to the bank and also the company. That way if they continue to set up the DD, they are acting illegally and you can nail them.

Well, I'll know for next time, mind you I don't set up DD's these days
There's your answer, many staff are clueless about direct debits. If what they say is true then it seems at odds with the direct debit guarantee, and it follows that you must cancel the account to be certain.
Virgin are also muppets.
Back to the original question check if cancelling the DD will mean she pays more for her power, this is often true.
The issue here is there is a credit over and above what your friend is paying (assuming the MDD is set at the correct level).
Speak to a manager, make a formal complaint, go as high as you need to.
I can see no reason why they can refuse to refund, unless of course they intend to pay interest
