Hello
Today i received a letter from Buchananclark and wells.
it was a formal demand letter for their client EDF Energy.
The letter show my previous address with reference of supply of electricity for the period 11/10.02 until 10/02/09 for £201.15.
I called EDF and asked what payments they are trying to collect from me and why have they not contacted me before hand. They say it was for the period 28th July 2008 until 3rd Oct 2008.
The thing is i left that address last year in July and settled all accounts when i left.
I believe i do not owe them any more money.
They have asked for me to supply them a tenancy agreement to show i left on the date i said i did but the thing is i do not have one to show i left because i left on bad terms with my land lord. I do not believe he will supply me with these details.
I clearly remember that me and my boyfriend went up to the offices of the land lord on a saturday just after we left the property and dropped off, the keys through the letter box.
I am not sure what else i can do to stop them chasing me for money i do not owe them.
I told the person at EDF that i can send him a copy of an invoice from the removal company to show i had my furniture collected from one address and taken to another and he was not happy with that.
In his words people can own many properties....which is true but surley they can do a credit check to show what mortages i own?
we purchased a flat so i have the signed docs for the day we exchanged. I did tell EDF that and they just said that you can have more than one property or live in more than one property.
In other words i owe them the money. I checked my experian credit report and that shows that i left the old place in july 08.
Just a though. What about my council tax bill. I had to change that over and you only pay council tax for the properly you live in so do you thank i sholud offer them a copy of that?
It is worth a shot - as you say, you can only pay CT on one principle property at a time and, if you were paying for a second address, surely it would show as such.
After all, they can only refuse to accept it.
Another thought, have you proof from the other utility companies - water and gas (if there was gas in the property) to show you cancelled them for the previous property on the same date?
I can see if i can find my water bill. if not i cn ask the water company to confirm that i contacted them to say i have moved. I do have BT installed in my new address and i choosed to keep my old number so they had to move my number across as well.
Moble phone bills are now to my new address. TV Licence has been changed to my new address as well.
Maybe i can write to them and include all these details
Actually, they have no tight to ask for ANY of that - and as they pointed out, you can have plenty bills for many different addresses, which all prove nothing.
What IS important, is that when you exited the property, that you provided EDF with a final reading, and paid this. After that you are immune from any subsequent claoms to pay for a supply that you have no responsibility for. I always advise folk to take a digital picture of their meters on the last day as a back up.
Finally, they need to prove you were responsible for the debt, not you needing to prove you didn;t, the the onus remains with them. If the consumption was running up after you left, then that s an issue for the landlord and his subsequent tenants, not you.
Finally, tell the DCA that the EDF claim is disputed, and to cool it until the matter is resolved.
I was planning to send them an email (and a recorded letter to back it up) showing them that all my other providers have acted on me advising them i have moved home.
I do not think i signed any EDF agreement when i moved in either. Shall i ask for a copy of the agreement to supply me with their service. This service was already there when we moved in and i think we just started to get letters from them.
What shall i do to get them to hold the despute and get my details removed from their system.
with regards to asking for a contract from edf, they do not need to provide you with them, it is a deemed contract that is valid until you change energy supplier and enter into an agreement with them.
Write to them and send either a copy confirming you purchased your property or a council tax bill if that shows an end date for your previous property.
It sounds to me that when you moved out and gave them your details in the first instance, you may have still been in an agreement with your landlord, he's had a bill through in his name, disputed it and told them you are responsible...
Thanks. I will send a letter to EDF asking them for a signed copy of my agreement and also a Council Tax Bill from my old address and the start of my new one for my new home.
I will also send a copy to the DLC explaining to them i have written to EDF and that the account is in dispute.
As nottslad noted, they do not require any signed agreement from you. As you've paid them before your are chading them with the wrong argument. You KNOW they were your supplier, it is only the amount being billed to you (I imagine?) after you left. Did you tell them you were moving out? Did you send them a final reading?
i told them i was leaving and gave them a reading but do not have the info any more. i kept it till the new FY and then shredded it. as it was archived and i did not need it any more.-stupid me. for somre reason i found my water bill which is a closing water service bill. Im now in my new home and pay BG.
They are only asking me to prove to them i left the propertly when i said i did.
What is acceptable proof of me leaving the properlty when i said i did.
Any copy of your letter giving notice to your landlord of your leaving date (in the absence of them providing you with something), a confirmation from RM that your letter redirection service is active to your new address, or anything vaguely official noting your upcoming change of address.
The only things i have are my current SP aware that i have moved home and my mail now coming to my new address. Most of this was done over the phone so did not need to write to them. My bank statements all come to my new address. I will see if i have a copy of the letter i sent to the land lord to say we are leaving. We went to drop the keys off at the estate agent on a saturday morning soon after we exchnged so we will not have anything from them.
