I have only just found this website and reading through some of the messages, it looks like it's about time I looked into pursueing this further! Can anybody give me any usuful tips, and any do's and don't?:o
Before you start please have a thorough read of the FAQs (there's a Step by Step guide here too). You may want to print these out to refer to later
Then look at other threads in your bank's forum, so as you know what you can expect to happen
You need to spend 2 or 3 days gradually getting your head round everything.
There's a lot to take in, but it's time well spent and will ensure that you succeed in your claim without problems
This is a self-help forum and you must be prepared to put in time and effort. It is your claim, your money and you cannot expect others to do all the work for you.
When you feel confident that you understand the process and the various stages involved, start a new thread in your bank's forum and post your progress and any questions there and you'll get plenty of help
a few tipes, stick to YOUR timetable, do not take any calls from the bank if you think they are going to intimidate you, Abbey are one of the worse to deal with but you will get your money back.

I'm lizi's father and I have just started down the road to recovering her charges. last month was £230 in charges which kept pushing her over her overdraft limit. One reason, apart from the fact that she's my daughter, is I am fed up with Abbey calling my house every night asking to speak to her! Why can't they pick on someone their own size!
Good on you ! My dad used to write letters to my bank for me about these charges, and did pretty well getting some of them back for me, he's away now, but he'll be well chuffed I have won mine back in full from the bank ! I'll stop asking him for loans to help me out

I've spent the last week reading up since joining this forum and have a pretty good idea how the system works. It definitely seems that as long as you keep to your timeline and not let the banks dictate, and hold your nerve it really isn't a great deal. it must have been pretty terrifing for the 1st people attempting it though.
Unfortunately I shall have to rejoin a ship before the end of this fight with the Abbey, but I'm attempting to teach Lizi and my wife in the ins and outs. Luckily we have satellite E-mail from our ships and I'll be able to keep them honest.
Welcome Lizi and Nik. I too have just started to take on Abbey and so far have found this site v. useful, lots of good advice and encouragement from the others so Good Luck Lizi and Bon Voyage Nik.
Tonight is the third time I (or we as a couple - now ex-couple) have sued them.
They never learn.
I used to think it was fake incompetence from Abbey, but now I realise the incompetence is completely real.
They are in a state, and I think before long they should be worrying about their credit licence!
What will happen with Abbey is this:
You will write asking for all your charges over the last 6 years.
They will claim that only the last 12-18 months is available to you.
You may then inform the IC (who currently has over 300 complaints about Abbey along, with regards to non-complience with the DPA - they are actively seeking a warrant to enter Abbey's property to have a look at their Microfiche system to see if it complies or evades the DPA), or start legal proceedings against them for non complience.
You will then get the info.
They will refuse to move when you send the lba in the library.
They will then acknowledge your claim once you start legal proceedings
They will then defend and you will get an aq.
You will complete the AQ
Either Alan Squires or DLA Barley, Quickly and Mcdrew (or whatever they're called) will then either a) try to scare you with talk of their legal costs, or b) offer you 50% of what you are claiming.
You will (or should) refuse the offer and continue to court.
The next letter will be one of complete capitulation and you will then get all of your money back.
Takes about 2 months.

Abbey DPA sent 3/8/06
You could always write to them quoting the Wireless Telegraphy Act (1949) informing them that you (or she) will only enter into correspondence with them in writing and for them not to phone again.
For them to phone after that is a criminal offence - and they WILL NOT phone again.
I did this with Cap1 for my mum, and they are b*stards when it comes to the phone - and guess what. No more calls.

I am writing to express my serious concerns regarding both the quantity and frequency of telephone calls that I have received from your company.
I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)
I am now formally requesting that all further correspondence be made in writing only.
I demand that these phone calls stop immediately. I am now familiar with the terms of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1970 and I believe your harassment places you in breach of these acts.
If you continue to call, you will also be in breach of the Wireless Telegraphy Act (1949) and, as such, I will report you to both Trading Standards and The Office of Fair Trading.
You will be deemed to have been served notice of my request no later than 2 working days after postage and I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence. (Even if you don‘t yet have recording equipment!!)
Just waiting for the usual 14 months of statements to come through then take it from there. Just had what I think is a note from a DCA come in the post this morning asking my daughter to ring urgently. Trying to get info out of my daughter is like getting blood out of stones. Still ,I shall take great delight in recovering her charges from as many Banks/credit card companies as I can.

They're little guardian angels, the lot of them. If ever you have a prob that you can't find in Q&A, there's normally someone online here that can point you in right direction. After all we're all on the same boat and all learning the same skills. Fortunately for us newbies, there are so many more of us with further experience with their claims... and the MODS and site helpers are a hive of legal information and common sense. I feel sure that your wife and Lizi will both do you proud whilst you're away...
28th July 06 - Data protection request taken into ABBEY branch with £10 cash... clock's started ticking! 05th August 06 - Microfiche arguement letter sent... In reply to first letter from Pam Speed, received from her this morning.
Just received the Standard Abbey Fob off letter from Pam Speed with the usual Microfiche arguement. The usual "will use your £10 to obtain them for you".
I was going to say dont worry about your wife and daughter whilst your away there are plenty of people in here to look after them, but then i realise just how that might sound.
Instead I shall suggest that there are plenty of people who can support and advise them in your absence.
Theres loads of us newbies in here starting on the road to reclaiming our money back from Abbey. Good luck and imsure youll get yourselves sorted.
