Default lost my job wages help

    Hiya can anyone help
I left work on 19th of May after being told there was no work the month before .

Signed on for JSA on the 20th went to sign today and was told my work place have still got me down as working for them .

JC advisor told me to get in touch with my employer as i needed my p45 to prove I havnt been working and signing on at the same time .
Phoned pay roll up to be told ur still on our books .

Got in touch with my previous manager she said well I told them you dont work for us anymore Ill ring u back stright away to see whats happened
    guess what no phone callicon.

My other problem is they owe me my month in hand wages and the hours I worked before I left plus all my holidayicon entitlement Which adds up to a fair bit (its due to be paid this monday.)

Payroll said they only have the hours what i worked last month down as they thought i was still working for them.

Obviously there has been a mix up on the companys part .Do they have to make me wait till next month to be paid up (holiday pay n month in hand )

Because if thats the case then I dont think I will be entitled to JSA .

Does anyone know my rights .

Your holidayicon entitlement is accrued at so many days per month. So if you are entitled to 24 days per year, this accrues at 2 days per month.

If you are 3 months into a leave year, then you have accrued 6 days, although most companies allow you to take more than you have accrued before the end of the leave year.

If you leave after 6 months into the leave year, then you have accrued 12 days. If you have not taken the 12 days, any of the 12 not used is paid to you. Any days over the 12, is deducted from your final salary.

Just to add to what boris has said, and as a practical example...

I get my new years holidayicon entitlement on the 1st Jan. The computer will say I have 28 days holiday to use (on the assumption I'll be working there the whole year) from that date. Obviously, if I leave before then it will be calculated in the way boris has said. So, if I take 12 days holiday in january it'll say I have 16 left...but if I leave in february I'd actually owe them money because they've allowed me to use it before I earnt it.

I'd suggest asking them confirmation of the hours worked with dates aswell, if possible, and then cross-check it against your payslips.

I'm not sure what you mean by 'month in hand' wages. You indicate that you're paid hourly so surely you'd be paid for the hours worked before the cut off date on each pay period? Though maybe I'm misunderstanding you on that one.
