Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
A county court has held that
there was no unfair relationship when there was a high
rate of interest but no credit checks were made and
the security was a second-hand car, the term was relatively
short but the rate was competitive (Nine Regions (T/A
Logbook Loans) v. Sadeer, Bromley County Court).
Ok, so this thread is all me, me, me, but please note that the court found the lbl "charges" of £100 repossession fee and the £100 legal charge had no particular basis for the rate. These fees were, therefore, unenforceable and disallowed...
If the case had been properly dealt with & pleaded using legal professionals, nothing would have gone in LBL's favour n'er mind a few charges getting chalked off!
