Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I'm new to the forums and am hoping you may be able to give me some advice.
I had my car repossessed yesterday, i spoke to the man on the phone and arranged to leave my car keys for him to get and his colleague was very agressive to me, shouting all kinds of abuse and threatening violence even through i was giving them details of how to get the car. I asked for his name as i want to put in a complaint and was told they would post a receipt through the door with the contact details on. I was persistant and got his name (well, what they told me was his name!) but i don't know what company they were from so don't have a phone number to get in contact and complain. Should they have provided me with a receipt to say they'd taken it? As far as i'm concerned had i not spoken to them and they had just towed it away, i might have thought that the car had been stolen.
Hi there, how long had you been paying for the car? was the repossession following court order? If you give a bit more information we can advise you further.
It was Fiat, i'd been paying for two years of a five year agreement when fell into arrears. After them being most unhelpful and refusing to come to an agreement they obtained a court order. I arranged a pick up for this morning yet they came round on Tuesday morning and were abusive and horrible. Should they have left me some documentation to say they’d taken it?
I didn't sign anything to voluntarily surrender it, it was on the street outside my house.
I had two dates to attend court, the 1st they didn’t show up and the second they had provided the wrong information, I hadn’t heard anything about a new date until I got a letter from the court saying they had had the case and fiat could take the car which is why I arranged a pick up for Thursday. Thanks for your help guys.
This is diabolical. Another case that I think is very very dubious. I am going to seek advice from a Judge this week as to the use of "agents" to repossess vehicles subject to ROG orders without the use of a warrant.
Thanks Markiemark, i've tried to complain about the member of staff but am having no luck with the company!
hi mate
me and my partner are in the same boat if you want to get your complaint put across then i suggest checking the finance and leasing assosiation to see if fiat are members if so make a complaint through them.
you can complain via the website.
her is the website FLA
thank you so much for your reply, Sadly fiat aren't members of the FLA, does anyone know anywhere else i can complain about this employee as i don't want anyone else to go through what i did with this awful man, thanks.
