Inland Revenue (the Grim Reaper Is Knockin At The Door) Help!!!!!!!!!
Dear All,
HELP!!!! HELP!!!! HELP!!!! HELP!!!!
Its a long time since I last posted and for anyone who read my last posting i've been beavering away just trying to keep going and keep all my staff in a job.
Any way HMRC have filed a petition for bankruptcy in the high court. The net result of this is I will not be able to be a Company Director and will have to shut down with the loss of 21 jobs.
The hearing has been scheduled for the 17th June and I have until the 10th June to enter a 6.19 to oppose the petition.
Is there anything else I can do as my accountant has filed my tax return and I own them far less than they are asking for (in the region of £5000 less) I'm not refusing to pay the debt but want it adjusting and for them to come to some arrangement to pay. Surely this is better than putting people out of work.
All my creditors in my company are paid up to date and I feel I have done my part to help the economy and safeguard peoples jobs at the expense of myself.
Why havent I hired a Solicitor? Quiet simply - can't afford one.
If anyone has any ideas and can help PLEASE PLEASE PLEASE DO!
I'm sinking fast and don't know where to turn!

You must act quickly. If the I/Rs sol asks for BR at the hearing, he is likely to get it unless you can convince the judge differently.

Lucky you - HMRC won't make me bankrupt, despite my requesting them on several occasions to do so.
Your business must be a limited company as you mention you are a director. It should be possible to find a director to replace you - your wife or a relative possibly. This means the business can continue uninterrupted.
Incidentally the restriction applies to directors, not shareholders. You don't have to sell your shares. If the company is a private company (which it almost certainly is) then the shares are not included in your assets for bankruptcy purposes.
I really do appreciate all those 'thank you' emails - I'm glad I've been able to help. Apologies if I haven't acknowledged all of them.
You can also ding my gong if you prefer.
