my dad was sold ppi insurance when he was already over the age limit
My dad has recently died, and i am the executor of his estate.
when i was going through all his finances i found he had a loan with payment protection with british gas.
I phoned them and they gave me the name and number of a company that deals with claims. anyway after sending the death certificate, i received a letter stating that they could not pay out on the PPI because my dad was 76 when he died and they only pay out if your under 70. well after some investigation i concluded that he was already over 70 when he took out the loan and the ppi. Talk about down right mis-selling. His date of birth is clearly visable on the credit aggreement., He would also have had to have given that information verbally to the person sorting it out on the phone. british gas have now refered the matter over to thier customer service. who after 3 weeks have not even sent me a letter.
My main questions are;?
Where do we stand on payment of the remainder of the loan.?
Will i have to pay it from his estate?
Any replies would be helpful.

They have miss-sold the PPI (NO DOUBT) i would wait and see what c/service say and then take it from there, do you have the loan agreement, and since when did british gas do loans.

Yes i do have the credit agreement.
No i don't have a solicitor.
And your right, i do have enough on my plate. everything was going ok re; accounts and such, until this happened
I know the debt is nothing to do with me per say, but it has angered me so much.
But i'm pleased to say they won't be getting any money, there is none.
Serves them right.

It could possibly be that you could reclaim the PPI as mis-sold and actually get some money back and have the debt written off.
It could be worth doing some further investigation.

Bank charge successes:
Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement
PPI Claims ongoing with:
Cap one Now with the FOS
Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc
Please do not PM me for advice as it may be sometime before I can respond.
Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

Well they have told me the settlement figure is just over 5.000.
I don't know how much PPI has been paid.
I'm still waiting for them to write to me. So i don't yet know what they intend to do.
After some more detective work i'v found out that british gas is just a front name ,the company that he really got the loan from was Centrica personal finance. They have recentlly been bought by your old nemisis RBS.
The loan is still active, and it was taken out in 2003. so he will have paid quite abit ppi by now.
Any advice?

You can search the register for details of a company. When I put in centrica finance this was the result and it came up with the AA personal finance link. It seems to be complicated but I am sure you will be able to resolve the issues of PPI mis-selling.

AA and british gas loans, are now under the umbrella of RBS. Its wonderful what info you can find on the internet.
Well i will phone them again tomorrow. if they don't know who i am, they will do by the end of the month.

I would go for it as debts do not die as such, they are paid out of any estate once funeral has been paid if there is nothing left after this of course then the debts die.
So as you are executor you have the right to chase this up for him anything you get back of course will go into his estate pot to clear any debts but once all debts are paid any left will go to relatives.
So in a nut shell go get that money it was clearly mis-sold and is his.

Sorry to hear about your dad, life sucks at times. I know how you are feeling hun. Its 6 weeks since my dad died.
I intend to see this through to the end. its what my dad would have done.
And you are right in every aspect concerning his estate.
Just wondered are there two banks. one called the royal Bank of Scotland, and one called the bank of scotland, or are they the same one?
