Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
It's been many years since I did my ACII but I remember from the law section the following case......
Customer took wedding/honeymoon photo's to Boots for developing, Boots screwed up and damaged the films so no photo's could be printed. Boot's offered them replacement films because in their terms and conditions this was stated as the limit of their liability, however the customers went to Court and won a much higher sum (ie in the thousands of pounds).
What I can't remember was the name of the case and I really could do with finding it.
I know we've got some great legal types on this forum, so if anybody could name the case I'd be really grateful (Please don't post suggestions about where I might look, believe me I've tried all the legal databases and law reports)
Thanks in advance
Mossy
PS I'd equally welcome any reference to cases where the stated terms and conditions have been totally over-ruled in Court
