    Default s.172 Road Traffic Act - failing to give driver details

    Hi all,

    Firstly, this forum has helped me out on a number of occasions. Well done and sincere thanks.

    I've received a notice of fine and collection order for failing to give driver information.

    The fine is £600 and 6 points.

    My question is can I make an appeal to reduce this?

    There were exceptional circumstances - only received summons when I make a call to the court, sent an email about my circumstances. ( losing job, can't recall having seen any other letters. on JSA, currently paying off a unpaid car tax fine

    Sorry, the information given is too scant to provide a cogent response.

    Did you receive a NIP/S.172? When? When and what was the alleged offence?
    Did you respond? How? When?
    Did you receive the summons? When?
    Did you plead? What?
    Did you attend Court?

    Is the notice from either Marston Group or Philips Collections Ltd?

    Both of these companies have the Contract with HMCS to enforce unpaid Magistrates Court Fine.

    You need to respond to PAT DAVIES on the questions raised and depending on your response it may well be that you can file a simple Statutory Declaration which will take the debt back from the bailifficon company and their fees will be removed.
