Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
This was brought up on someone's thread in the Barclaycard section but didnt want to hijack an further so was looking for some advice from people who have been in the same situation as myself..
I sent a request to Barclaycard for my statements from the past 6 years after they had initially offered me a payment (approx less than half what i was expecting) that i rejected. About a week later i received a pack of statements, but someone else's! :o
This pack was dated the 16th July, unfortunately due to work issues i've been unable to pencil a reply explaining that i've received someone elses statements. Does anyone have any idea what i should include in this letter? where it should be sent? what to do with the other person's statements?
These were received 2 weeks ago and I'm yet to receive my statements, which now could have been sent anywhere!
Surely there should be Data Protection Laws etc which should protect against this sort of thing happening?
Any advice would be much appreciated as I'm looking to get a reply sent to them today/tomorrow.
I would contact the IC immediatly. This is absolutely disgusting behaviour from a data controller.
They have a duty of care whan it comes to peoples information - the fact that some poor sod on minumum wage has been asked to fill the envelopes up is not our concern, or that of the law.
They are in grave breach of the DPA - you MUST inform the IC (who probably won't care anyway).
If you don't get a satifactory answer from the IC, let me know and I'll contact a newspaper or two.
This sort of thing when it comes to peoples personal information has to stop - you are not the first to have this happen by a long shot.

I've just spoken to the helpline at the Information Commissioner's office and they've advised me to put a compliant form to them with a copy of one of the pages from the statement sent. They are then going to take the case forward on my behalf.
