Four years ago to the day I was repossed. Not a nice experience as you will know if you have or are waiting to go through it.As a result I had a nervous Breakdown and am still suffering from bouts of depression. Only now am I begining to recover my life.Anyway when I checked my credit file yesterday there is no mention about said repossion,no court details nothing! The case was brought by our friends at GEMoney. Not that I'm complaining about non apperance on file. Just wondered if the whole thing was legal, having read all the stories about securitisation on here. Any thoughts anyone? I did'nt know about legal matters like this then- wish I had found CAG! Might have saved the house.

Basically what happened was that I had inherited the bunalow from my late parents. Both deceased around 2000. I got into difficulties with debt due to taking early retirement on medical grounds. Got a mortgage. Missed payments usual story then had a suspended order in early 2005. Repro in June 05. Property sold for 136k in Nov 05. Market value was 155k at the time handled by local estate agent. Funds cleared mortgage. But knowing what I know now (thanks to CAG) I feel that there was some underhand dealing going on. I got back some funds. I have read a lot about all the underhand dealing that goes on with these companies. Seems they don't want you to pay off the debt just want your house. Local council did'nt want to know me -usual reason made myself homeless! However thanks to a local charity that deals which such problems(as single broken down males) I am now in a fair but not perfect position. Oh yes I lost my partner when she left at the same time! Funny how they don't want to know you when things get tough! Never mind it can only get better and I might win the lottery!
If you went to court and they issued the possession order then I can not see a problem there.presumably you agreed the amount of arrears and the fact that you could not continue to pay the mortgage. Your argument seems to be that perhaps they undersold the property. for that you would need to prove how hey marketed it and for how long and who bought the property - did they then sell it on for a quick profit?
But as mentioned above you may be stirring up a hornets nest so you really need to be clear about what you want to achieve and what your arguments would be.
Not all loans and mortgages are registered on the credit reference agencies, I have a number of friends who have asked me to go over their finances and when looking at their credit files loans from the likes of GE are nowhere to be seen. Mortgages taken out before the CRA's existed wouldn't show either if they are still running.
I really sympathise with your situation, but it is all too common on these forums to read about. TideTurner is a classic example of what you went through and I'm really pleased to hear you are getting out of it. If you are up for it, have all your records or are now in the frame of mind where you want to revisit all this I'd actually go about doing this just to clear your head. You've lost a lot but take GE for example, they slap charges on the ground you walk on and it maybe that you could have done things differently had the arrears not been all they were as a result of these charges. You can be sure they claimed everything when the house was sold. There are some things precious like partners, husbands, wives and kids you might find not so easy to recover but if this is bugging you then you won't be causing any damage to yourself by doing the searching.
You can find prices of property in your area on the net these days at the time it was sold and can make enquiries.
There's a lot to be said for the other advice on here too about drawing a line under the past and moving on, but that's something for your own conscience, if you feel aggrieved and you will spend years wondering if you have been ripped off then clear that from your head by researching. There's so much support from people on here believe me, if you have the passion to do this, set yourself a thread for each aspect and link it to this one and plot, scheme, uncover -then and only then will you be able to move on - you may achieve nothing else other than having the satisfaction of knowing, but then, and only then will you move on.
Securitisation is a new issue, but just supposing GE had no right to be in court applying for a repossession, what would you feel then? There is much to be proved on that and many say it's a red herring. I've gone digging on that myself and it's a long haul finding something which no-one out there wants you to know. People are uncovering many things and American companies have different rules on securitisation than UK ones - but the answers are out there. charges on your account, dodgy estate agents underselling to building contractor mates EVERYTHING has come up on here so dig my friend and I wish you good speed. Life is short so never lose focus on a little enjoyment too...
