    Hi Beachy and Angel,

    Interesting stuff.
    Guess what? Yes, I got the same letter today as well.

    Any ideas how to suggest to them that they need to respond to our CPR 31.16 and not send out letters trying to put us off the track?
    I have snet both my CPR letteres and am still waiting a proper reply.

    Have now got Mercers and Calders after me but have told both of them, (via Bcd not direct to them as I will not acknowledge there is any business between us) to go away and communicate in writing only.
    They won't listen of course!

    Maybe Pt or someone else has an idea of how to deal with this letter.
    Or do we just ignore it as it is irrelevant anyway and just shows their lack of ability to respond to formal and reasonable requests.

    Am away for a few days from tomorrow so will check in again on my return.

    Slick, thanks for the pointer to Bradley68 and Gary 68.
    I will take a gander and see if there is anything there for me to use as well.

    These idiots seem to live in a world of their own, I have had a letter from Calders telling me they are after me and will pass my account onto a local agent to call and collect in full and, in the same post, a letter from powwer2Connect saying Mercers have passed it to them to collect!

    Now, what does the law say about two companies chasing the same debt, let alone three or four?

    And all the time Barclaycard just ignore letters to them, CPR requests et al and simply send poor copies of the latest T&C's not forgetting their latest 3 page 'we've done all we should' letter to everyone.

    Time to get tougher with them I think.

    Back from a few days away and have had a few more letters from my best friends!
    I have posted the following on another 2 threads, Angel v b'cd & Mercers debt collectionicon, but in case anyone is looking here as well here goes with todays update -

    Hi All,

    In a bit of an annoyed state about the third DCA to be set on me I have telephoned Barclaysicon on three numbers and they all ended up in Mumbai.
    No thanks, I've had my ID cloned already so I am not telling any overseas outfit any of my security answers thanks.

    Eventually found this number for the UK Customer Service Unit - their name for it not mine - it is 0844 241 2978.

    So I called and spoke to a young lady and complained about their 3 DCA's all chasing me when the accounts are in offical dispute.
    She asked why they are in dispute, so I told her, she asked had I Sec 77-78 requested info and said No it was a CPR request.

    She then went on to say she can get this info, print it off and send it to me within about 2 weeks...............is this wonder woman I ask myself, or just another disillusioned Barclays employee off to search for what we all believe does not exist.

    But the best bit is that she has said in view of my complaint she will put all the chasing activity on hold for 28 days whilst they get my complaint & CPR request sorted out...................... seeing is believing.

    Go on, call them and give it a try if nothing else if we all call them it will give them a taste of their own medicine. Sadly though its only a 9-5 monday to saturday number not an 0800 to 2100 seven days a week number.

    We've seen cases where users have been promised their credit agreement but nothing has appeared apart from the usual T&C's.

    Also, if you have not sent a CCA request to BC, the a/c is not really in dispute. It doesn't matter a whole lot because, even if you send BC a CCA request, they'll still not agree the a/c is in dispute anyway !!

    i understand totally what you are saying, but this is the fact of the matter, that bc really i think now are trying the offense rule,,,, and to see how many of us will fight back,,, and we must continue or all will have been in vain in trying to asert our own rights

    the banks need to get their own house in order before they judge their customers

    just my thoughts, i will however continue to write to them just cos im a bit of rebel and i refuse point blank to talk to them,,,

    Yes, I agree that Bcd are seemingly on the offensive a bit now. Maybe all us caggers are getting to them....shame.

    I am sure my 'helpful lady' will fail, just like the rest of them have so far.
    At least it gives me 28 days peace and quiet from the phone harrasment tactics!

    You are right when you say that we must all continue to fight our corner, that way maybe we can get things changed for the common good.

    oh i always do try and say to myself im going to have a good day today,,then sometimes life throws a brick at you

    and you have to duck pretty fast lol

    i do have my off days and feel down,,but never really negative as such i do hope that my posts reflect that at least,,,,,

    but i do realise when i can get myself focused on something i do find it does help me with passion in getting things done correctly and to get results, however the road we travel i do try and remember there will be bumps along the way at times,,,,just a bit of a phase and it passes,,,,

    without CAGicon, i think i would not be at all well again,,,so i thank each of you of posting because it does help to feel united in what we want to all achieve

    Hi Slick,

    As promised an update on the telephone number.
    The number appears to be useful

    I have received a copy of an application form signed by me but not by B'cd for one of the two accounts in question.
    It just came in an envelope with no letter or comps slip, nothing else in the envelope, not even a copy of t&c's or an executed agreement.

    The copy is reasonably legible but not the small print part, all I can make out is that I signed it in 1999 but they did not.
    It also shows that I requested PPIicon but thats not running on this account......hmmm, an interesting development I think!:grin:

    I still have not seen a copy of the original agreement but I doubt that it even exists.

    So, in short, the number is good in that the one lady does seem able to do what she says
    but
    then again its not the documentation that has been requested but it is more than I have seen from them so far.

    I will wait to see if the second account info arrives.
    Somehow I doubt this as its an old MSDW card that morphed into a Goldfish and then again into a B'cd.

    This morning I received a letter from Credit Solutions/Power 2 contact saying its a formal demand for payment and to make full payment immediately to them.

    Oddly enough Bcd still have not managed to send anything that resembles an agreement on this old MSDW/Goldfish/Bcd.
    They just ignore my CPR letters with the exception of the blanket three page 'we've done all we need to under Sect 78 of the CCA 1974' letter as described elsewhere in many other threads.

    This account went into Dispute in March 2009 & formal notice was given to them as rerquired. The account has grown steadily with additional fess and interesticon even though its in dispute.

    The letter today says I have ignored the Default Notice recently sent.........no I haven't, they have not sent one.

    Having checked out CSL, their website makes some interesting claims to their target clients such as -
    Litigation
    Debtors are becoming increasingly aware of their rights and, more importantly, the processes of DCAs in recovering debt. (Well done all you Caggers, PT et al! ) As such, it is more important than ever to select the right accounts for the Litigation process. The objective of our service is therefore to identify the accounts which are most likely to result in payment after successful Litigation.
    The report which we provide will contain all of the information that our office-based team have been able to collate, supported by additional information which we gather via power2contact, our field services division. This division utilises fully-employed Contact Managers who are able to gather detailed pre-sue report information in the field, which dramatically increases our ability to positively select accounts for Litigation.

    And this is their one of their proposed strategies –
    • utilising the kicker of third party involvement
    • a full outsource from day one past due - where we assume your company name
    • pre-due courtesy calling
    So its there for all of us to see how they intend to operate.......they even boast about visiting neighbours!


    Just about to send both Bcd and CSL the OFT DCAicon guidleines letter and remind them that the account is in disputeicon and ask yet again about why they have not been able to locate any agreement paperwork at all.

    Can it be they dont have any?????

    Not very subtle, are they

    Some users have been sent agreements for a/c's which BC took-over. Clearly, you're not one of them.

    BC are unlikely to budge now unless you force their hand using the next stage of the CPR strategy.

    CSL Subtle............Not a hope.

    They cannot read either, I have had two calls this morning from them despite faxing a letter to them & Bcd on Saturday saying 'go away' or produce the documents you hold.

    The trouble with Bcd is that you never get to hear back from the same person you write to or request info from.

    It will be interesting to see if they come up with any paperwork showing any agreement with them.

    Update on CSL/Barclaycard and Cloggy!

    I wrote to CSL with the Bog off letter and received the following from them today -

    "I can confirm that we have removed your telephone number from our system and further correspondance will be by letter.

    CSL offer a doorstep collectionicon service whereby field agents visit a property to discuss repayment of an outstanding amount. This is simply anopther optuion available to our customers to assist them in repaying their debts. In relation to field visits in subsection 2.12 of OFT guidelines doorstep visits must give adequate notice of the time and date of visit. The armstrong v Sheppard (1959) case you quoted is dependant on each individual circumstance and only such order to refuse access can come from a Court and not from the individual."

    Barclaycard still have not been able to produce a signed agreement and CSL say Bcd have sent me a copy of their T&C's so that fulfills my requests under CCA sect 74.
    NAturally, I have NOT made a CCA request but have used CPR instead.

    Oddly enough, I have not even seen the current T&C's let alone any agreement.

    So I will drop these oiks a line to remind them I have already told them I do not want a field visit............how do they know if I have a field anyway?

    I guess its time to pull up the drawbridge and start to boil some oil.
    Apparently as a tactic to repel those who would wish to gain entry to an Englishmans Castle in the old days, it is said to have worked well enough.
