Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
In January I bought a bed from a power seller shop on ebay, using the Buy It Now option.
I didn't actually put the thing together until I moved house at the end of February and since then have had problems with slats falling out etc. Now the rail that the slats fit into has come away from the side of the bed completely, leaving it broken, very fragile and (from what I can see) not able to be fixed.
I don't have the original emails from ebay but will have record of my paypal payment and feedback, proving the transaction.
Do I have any rights regarding a refund or replacement?
Basically that under Sale of Goods Act 1979 - s. 14 on satisfactory quality.
They may say that as it was bought in Feb, then rejection time has gone bye bye. I would say however that as you bought it before moving home, you have a good case of saying that "reasonable chance to inspect" has not passed.
You may of course have a replacement if you prefer. Contact them and see what they say.
