Just before christmas just gone I was successful in getting the HSBC to agree to my claim for mis sold PPI on two loan accounts, 1 account paid off and one still in force. The bank wanted me to go back to branch and re structure my loan before paying me out... I didnt do this for the following reason
I CCA'd the HSBC for original agreements on both this loan and my credit card. No documents were sent to me and so I placed both accounts in dispute - This is still on going
Now, I dont see why the bank do not pay me my PPI as they agreed in writing (approx £2,500) other than they are being silly because of the defaulted accounts, after all the PPI would not figure in the resolution of the defaulted accounts as far as I can see.
I have sent letters to request payment of the PPI but suprise, still heard nothing.
Just need to know if I can take this to small claims or any other action I can take please.
You are trying to reclaim PPI on what you term disputed accounts. ie you say that they have not provided you with a valid agreement, therefore there can be no ppi applied, so they wont pay out what does not exist, if you get my drift.

Yeah I see, I was kinda thinkin of leaving the PPI issue in the event I have to negotiate the clearing of these accounts back to zero balance - Leverage if you like
