Hi everyone, my names kevin, and im a fool for buying a mattress dreams. lol.
I recieved the mattress in my house on 6th december 2007.
The mattress developed a fault within a 14 months, it was reduced in the sale to 1/2 price and cost about £1500. we took it out on buy now pay later, and if not paid we would owe the full amount. credit was with Barclays.
We paid off in full before the year ended. I took out the extra care (£20).
The fault is that the matress has become lumpy and the foam top has moved to an angle and does not sit squarely on the pocket sprung mattress base. if you seen the pictues it really is out of place alot, so it doesnt distribute the weight evenly either, thats why i feel i little sagging and not as well supported.
Dreams sent out a bed tech when i complained. he said it was general wear and tear! so they would not replace it. i said rubbish,
I asked them for a copy, they said if i paid £20 they would send me a copy. so i said i wanted it looked at again. they said £40 if i disputed it.
so i got my own one done for £50 and a copy. he said a fault has developed in the mattress which is not by general wear and tear, ordone by our actions, therefore is not our liability and should in his opinion be redressed by a like for like replacment.
my question is this, i will send them a copy, but this report has cost me £50 so can i ask for a refund. also can i charge them £20 admin fee as this has taken me a lot of time to get sorted.
I suggest that you write out the full explanation of everything that has happened in a letter. Include a copy of the report and the Bill. Let them know that you are now seeking repayment of all your expenses as well.
Insist that the mattress is replaced -- not repaired. It is clear that otherwise you would not have a mattress to sleep on.
Given seven days to sort it out in full failing which you will be in action in the county court.
If you had to go to court, you will get all your expenses and your court fee.
Don't make the threats unless you are sincere about taking the action. It is not worth bluffing.

We are writing to you in relation to an ongoing problem we are having with a faulty product we purchased from you.

On 07/11/2007,
we bought a mattress from your branch in Strood, since the purchase date we have realised that the product has developed a serious fault that is not from general wear and tear, as suggested by your bed technician. We have had my own, independent survey done, please see enclosed report.
The Sale Of Goods Act Amended states that The Goods Must Be Of Satisfactory Quality, due to the fault described in the enclosed report, I do not believe that the item complies with the above legislation.
We have also taken out the 10 year guarantee at an extra cost.
We request that the goods are promptly replaced so that we do not suffer any further inconvenience.
We also request that we are fully reimbursed for the cost of the independent review we had carried out + £20 administration fee.
Should you fail to furnish us with replacement goods + costs within 14 days or reply to this letter within 7 days, I regret to inform you we shall be seeking to commence court proceeding for breach of Contract Terms including all costs incurred.
I hope that such action will not be required.
I have included my name, my partners name, our new addresss, partners telephone number and a copy of the inspection report and a bill.
I called dreams yesterday to check they have recieved my letter.
The lady on the phone said they had recieved my letter, stating that they were not willing to except the inspection because it wasn't from one of there approved compaines and they would not refund the cost's?????
Dreams never told me on the phone that if i had my own independant inspection done it would have to be from one of there approved compaines. They are saying that they are willing to get anouther one done for free now(last time it would cost me £40).
Now i have already taken time off work so these two inspections can be carried out and what will a third inspection find that the first two didn't?
The matyress is faulty!
I spoke to consumer direct who said for it to be an independent report we both have to agree to the compaines, but, they did say i could argue that if i use one on there suppliers list, it wouldnt be truly independent either!
I dont know what to do now? Im still waiting for the letter to arrive.
