Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Yesterday I got a letter through from Telegram, who were corresponding as the authorised agent for Capquest Investment Ltd and requesting to make the necessary enquires to establish my current residential address, which is Irvine, Ayrshire (though they'd put Irvine, Hampshire, the letter still got to me as the postcode and rest of the address was correct)
It stated their client (Capquest) had an obligation to update their file with data concerning change of addresses.
Considering I've not long finished paying a debt for about £550 to them in regards to an old Royal Bank of Scotland account, i thought this was what the letter was in concern of. I phoned Telegram to verify my address, and asked what it was about as I'd paid off my debt with Capquest, and was this just a case of updating their records.
They said i had to speak to Capquest, so i phoned them up and asked them what it was about. Was told that it was nothing to do with my Bank of Scotland debt, but was an outstanding debt from Capital One of about £600. After having the guy on the telephone ask about what i did for work, how much i earned a week and whether i had a car (Don't know the relevance of that), he said i had to make a payment then and there, asking me if i could get help from my family to pay it, to which i replied my family are all poor.
Argued for about 5mins over the fact i would be willing to pay £50 a month (They wanted more) he took my bank details and set up a direct debit for the 2nd of June.
I realize now it was stupid to do all this over the phone, but i'd come off an 18hr shift the night before and wasn't thinking too straight. Also i work security, so threats of taking action against me made me panic as i don't want to risk losing my sia badge over debt.
What im thinking now is that £600 seems a bit much for what i remember that card having a £200 limit. That would have been when i was based in aldershot in the army back in 2003, but surely the interest on it going unpaid couldn't have amounted to the amount tripling?
Im just confused at the moment, so is there a way i can get them to show how i owe this much money, and would i be entitled to cancel the direct debit coming into effect while i wait for them to send such evidence?
I don't really know anything about debt laws, so any help would be much appreciated.

Telogram is a part of Capquest, who've broken OFT guidelines by asking you to get money from other people - you should also make a complaint to the OFT about this.
Yeh, never talk or agree to anything with them over the phone! They've been doing that for years with me, pestering me evry three months for an increase and threatening 'action' if I don't. What with the DCA's and the banks my wife and I were a bag of nerves for years until we found this site! The assistance you will receive here is invaluable and will put the power back into your hands.
