I sent off a SAR and CCA request to Lloyds which they signed for on the 5th May.
Recieved a letter today along with my cheques for the fees, basically saying they need more information. It goes like this:
Dear c
Thankyou for your recent letter.
Please note that section 78 of the CCA 1974 is entirely seperate from the Data Protection Legislation and Data SAR. As such, we are only obliged to comply with request made under section 78 of the CCA if we recieve the fee stated in section 78(1) This fee is currently £1. Unfortunately we have not recieved enough details from you to find and process your request. Please re-send your letter with the relevant card numbers, account details and up to date home address. Lloyds TSB credit card numbers generally contain 15 or 16 digits.
If you would still like to make a request pursuant to section 78 of the CCA, please write with the appropriate authorisation and fee to : 'address'
I hope I have now clarified our postition.
I dont understand this, especially when I made it totally clear 'I request CCA...I enclose £1 to cover the fee....to be used solely for this'.
We have been communicating by letter for weeks now, so why do they need more info now? And they seem to forget that they actually sent me a letter the other week with all of my account numbers etc on it.
Does anyone know what they are playing at? And whats my next step, do I just send it to them or accuse them of stalling?

I agree they are stalling, I have sent cca request heard nothing but "we will be investigating your complaint"(still adding charges though),
I have sent off under the SAR and now I have received a 4 page application form for imformation on the account numbers which I already sent and they clearly already have.(£10 fee included) also im asking for the PPI details on any loans and they are also asking for the account numbers and a EXTRA £10 fee for these joke.
I have just had a rare conversation with there tele sales who were asking for payment and he said they had set up a new address for requests.

Im just letting you know that there seems to be a lot of people in the tsb queue of stalling tactics with us and I also would like to know the next step hope fully some one with a nice letter

Yes same here. I think I might just send them the info, because it is eventually going to come to light what they exactly hold.
With regards to them asking for an additional £10, dont send it to them. A SAR is for every bit of data that company hold about you. They cant ask for extra money!

phoned on the direct number today and asked if they had received my £10 (they have) and couldnt understand why they wanted more info,It was apparently my signature for data protection,yeah right..
anyway she was rather helpful and knew that I was after loans + protection etc...told her I wasnt paying anymore money for seperate insurance data and she said I was entitled to have everything on file.(which of course we know)
To save any more delay I have signed another SAR letter filled the 4 page form and crossed my signature.

Thanks gary, I might try that number myself. I have read a lot of people on here have recieved a four page form to fill out, whereas I just got a letter asking for me to write again with my details. Strange
Well I need to get some ink for my printer (too many letters going out) and then I will send them the info they so desperately need to operate a simple request.
And thats good putting a line through your sig, we cant trust these banks can we?

I have just realised something. On the letter they sent they said the CCA 1974 is seperate from Data protection and SAR therfore they are only obliged to comply with cca request.
Does this means they can refuse a SAR?
If it doesnt does this further add to the case they are stalling?

Did you send a cca request as template letter with a £1 postal order recorded delivery?
and a seperate subject to access request with a £10 postal order-recorded delivery?
did you put the account numbers on ?.
I done it all as one letter, but with 2 different cheques. Thats OK isnt it? As its worked with other companies. I put them in one letter as I requested other things as well. I am contending the PPI as I know for a fact I never agreed to it, so in reply to their fob off letter I asked for a SAR ans CCA.
And no I didnt put any account numbers in ooops! But I did use a ref number that we have been using in the letters that have been going between us.
I have sent a new request off today, for both SAR and CCA. This time I have given them my card number!

But just an update:
Now I have recieved a letter requesting my signature to proceed with my SAR!!
Just need to know if they actually need my sig for a SAR before I decide my next course of action.
This is annoying me now because they have already requested info, which was my fault I admit, but they said nothing about a sig. I even told them in my requests that anymore requests for info will be seen as a stalling method.
Really angry

2. Do you have enough information to be sure of the requester’s identity?
Often you will have no reason to doubt a person’s identity. For example, if a person with whom you have regular contact sends a letter from their known address it may be safe to assume that they are who they say they are.
However, I doubt even quoting the above will get you the information you want without a signature... so import the following into your page, resize and sign over it. You could if you wish, add a little extra to your signature.. such as a (.) where you wouldnt normally, extend the tail of one of your letters, etc, etc. However if you "alter" your signature slightly, keep a copy so you will recognise it should it turn up on anything it shouldnt.

Thanks citizen, used that in my letter. Its also been 2 months since my CCA request, and they have cashed the cheque! So just asked them if they think I should inform the Information Commisioner, and gave them 14 days to sort out my 5 month old complaint or that will forwarded to the relevant people too.
