I was diagnosed with severe Obstructive Sleep Apnea in October last year. On my sleep test it registered i stopped breathing when i am asleep 63 times an hour, thus meaning i do not have any deep sleep at all. The consultant said everybody needs a minimum of 4.5 hours of undisturbed deep sleep to recover from the days fatigues, this is a medical fact.
I was given a CPAP machine to help me breath when i am asleep. It basicly pushes room air up my nose at a very high pressure to prevent my airway from collapsing when i am asleep.
I currently get about 3.5 to 4 hours of deep sleep most nights, which is alot better than what i was getting (i fell asleep at least 6 times a day at random times in random places).
I work a 12.5 hour days but only 3 days consecutivley which is not the best thing to do with this condition but i have 3 young children so i need to make sure there is always money coming in. My wife dos not work and wont because she can not leave the children with me as there is a high chance of me falling asleep when i am looking after them and child care in the local area would cancel any money earned out.
Although there are jobs out there that are more suited to my condition it is difficult to get one because i have given up driving and using public transport is to risky.
I applied for DLA which i thought i may of got the lower rate which would make things alot easier on the money side of things, it was turned down. I asked them to take another look at the claim so i wrote a letter explaining in more detail the problems i have to deal with on a day to day basis.
I got another letter saying that the answer is still no, although they aknowledge i have a sevre medical conditon which is still not under control i still dont fall into there criteria.
They based there desicion on what i wrote in the form and letter. I feel i may not of explained fully how my day to day life is effected by this.
I am hoping that someone on here can point me in the right direction of appealing or maybe tutor me on how to do this.
The condition dos come under the Disabilty Discriminations Act and is listed on there medical conditions data base.
