Hi, I'm in the same boat with BC. So, since a particulalry harrassing call on Friday I found this site and have been gemming up big time on my rights. I have a script by the phone re this ready for when the next human being calls (as they are interspersed with computer calls) but unfortunately I've only had the comuputer since I wrote it! I have also sent an e-mail to any name anyone has been helpful enought to provide, as Barclays follows the common naming protocol of xx.xx@barclays.com or @barclaycard.co.uk. I have copied John Varley, Barclays CEO in my latest e-mail. Frankly, I don't see the point in a system that requires financial institutions to follow OFT guidelines to be granted a licence to operate then does nothing about them clearly flouting the rules of engagement. I have been told categorically that BC will NOT speak to an authorised 3rd party and will NOT agree to a payment plan. Unfortunately this is before I get the ability to record calls but rest assured I will be logging every and all conversations with this outfit. Their actions with vulnerable individuals are as bad, if not worse, than the loan sharks we hear about. Worse because they believe they are above the law. BTW, an IVA doens't help with these guys either as they ignore those too! I have a friend whose IVA is now in place who is still being harrassed by Mercers (BC's internal debt collection department)! All I can say now to them is BRING IT ON! I'm just getting warmed up!

so, I just got off the phone with a person from Barclaycard. Here's how it went:
BC: can I speak to xxxx
BBNB: Speaking
BC: this is Jean from BC, can I confirm your DOB
BBNB: No, but I do have something to say to you, hang on. [slight pause]:
Can I just confirm that you are calling from BC?
BC: Yes ma'am
BBNB: Just to let you know that I am taping this conversatin and I intend to report you to the office of Fair Trading under Section 40 of the Administration of Justice Act 1970 for harrassment. From this point on I will only communicate with you in writing and any further calls from BC will be cause to instigate criminal proceedings under Section 2 of the Protection from Harrassment Act 1997 and your consumer credit licence does not protect you from prosectution.
BC: pause
BBNB: can you confirm as per the conversation I had with you yesterday that you refuse to speak with my appointed 3rd part representatives
BC: I cannot access your file as I don't have the security confirmation
BBNB: Well I don't believe that. Can you also confirm that you will not agree to a payment pla, as I was told yesterday.
BC: I cannot discuss that as I can't open your file;
BBNB: Well I have written to you and spoken with you on numerous occasions as have my 3rd party representatives and you are infact now receiving money under this plan.
BC: I can stop thesse calls.
BBNB: can you repeat that please
BC: I can stop these calls, I can do that.
BBNB: What is your name, "Jean..."?
BC: Jean Xxx
BBNB: Can you spell that please?
BC: Jean Bathan
BBNB: And you will stop these calls? You are able to do that?
BC: Yes Ma'am
BBNB: Thank you and goodbye.

BTW: my e-mails have nearly all bounced back as the people have left I assume ..... all accept the one to John Farley (CEO).............
Keep your spirits up folks. But for your support on this sight i would have blathered and been stressed and upset by the call. Now I'm confident and proud to stick up for my rights!

Just a quick update folks. After my conversation yesterday at about 1530, I haven't heard a peep from them. I'll be interested to see how many messages are left on the ans phone when I get home from work!
OK folks. So I have had the charges for the last 2 months removed from my account and the Director's office has stopped all calls. I will speak with them tomorrow to discuss their actions and those of Mercers. Watch this space. But the moral of the story is persevere and go as high up as you can in the food chain to be heard...
Last posting. I have spoken to the Directors office. They have accepted my payment plan. They have provided a small amount of compensation which I'm happy with. They have stopped all calls. They have removed all charges on the account and have frozen the interest at zero. I believe its a case of being firm but polite and knowing your rights. Once I got to the right level they couldn't have handled my case any faster or more decisively. I did stress the point about them and in particular Mercers. So, over and out. Good luck everyone. I'll keep reading to see how you're all getting on!

No. That wasn't my beef with them. I've only incurred penalty charges for a couple of months as I sorted out my situation after falling into financial difficulties. 9 calls a day for 2 months was enough for me - I couldn't have withstood years of this!
