    Default Help with disciplinary/data protection

    Hello all

    My friend and colleague at work has asked me to accompany him to a disciplinary on Monday.

    We work within the sports betting industry.

    My friend placed a bet online with Company A. The bet was dodgy due to the results already having been released. However, the company did not update their site, enabling my friend (and presumably others) to place a bet already knowing the outcome. Company A caught on. The bet was void and no winnings were paid out.

    Company A then informed our company, Company B, of the incident. It is this which has led to my friend being suspended pending his disciplinary on Monday.

    My queries are as follows:

    Can Company A release details of this incident which obviously included details of the bets placed on my friends account?

    Can Company B use/rely on this information to then take disciplinary steps, claiming bringing the name into disrepute?

    If my friend decided to take action against Company A for breaking Data Protection, would Company B also be liable for using/relying on this information?

    sorry I think you are going to have to be more specific, am I correct in assuming both company A & B are involved in the gaming industry

    Yes. Both company A and B are gaming companies. A its a very incestuous industry. The bosses at A know that my friend is an employee of B and have complained directly. I wonder tho, if someone not employed by the gaming industry would have been subject to the same treatment with regards their data?

    Sorry I think your friend will have some difficulty here and may well be dismissedicon.
    IMHO I really cant see the data protection argument being of any use.
    The wager or bet was placed fraudulently, I'm not an expert in law however is his/her action not criminal;
    certainly their honesty is being questioned.

    I think your friend has to ask himself if he would have preferred it if Company A contacted the Police regarding the fraudulent activity as opposed to going directly to your Company B.

    Either way, Company B would have found out and I think it's fair to say that Company A were not being malicious in divulging this information.

    I take onboard your points. However, whether the bet was fraudulent is a case in itself. Company A left the data online after the results had been given. They left the facility to place the bet open and indeed then continued to accept and payout the bet. Only when they realised their mistake did they void the bet. Whether under the circumstances this would be classed as fraudulent, I am not sure.

    Thanks for your responses. I will be using this to advise my friend. I think he should sit back and say fair cop. As you point out, better than taking a legal route.
