Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I am trying to get my head around the changes with regards to the wording of the letters, i have 4 claims on hold with 2 seperate banks following the claims letters being issued 03/2008 to them about the time they put things on hold. Do i need to issue new letters to them changing the wording about penelties?????? or will the original template letters still stand as the bank has issued me a on hold letter....
confused i am
did the consumer credit letters, then detailed claim with spread sheets, then the pay in 14 days letter then received the your claim is on hold letter, since then i have waited for the OFT court case.
its sheriffs courts up here, and theres a claim limit for small claims courts.
thanks for your help, nothing ventured nothing gained. the banks are crafty, while you wait for them to reply they change the rules....
I started doing my claims through Edinburgh Sheriff Court.
I think small claims limit was £750 when I claimed, so a lot of people had to split their claims, the Banks then said they thought this was an abuse of process and some courts started throwing out more than one claim on the same account.
That's why I went with a Summary Cause claim, with the limit being that bit higher.
Small claims is now up to £3,000 and Summary Cause £5,000.
Regards.
Scott.
