    Default Welcome Finance PPI help!!!

    Hi im new to the forum and could really do with some help after reading other posts on here i have started chasing welcome finance for misselling me a PPIicon policy.

    I began by sending them this letter:

    Dear sir or madam

    Account number ***********

    I purchased payment protection insurance on the above hire purchase from you on 28 march 2005 bu now believe the policy to be missold for the following reasons:

    - I was not given the correct information when the policy was sold to me
    - Your salesperson stated/implied that taking out the policy would assist my credit application
    - Even though i intially refused to take out a policy your salesmen went away and brought in a colleague to persueade me to take out the policy
    - Both your salespersons stated/implied that taking out the policy was essential for me to get the assosciated credit.
    - I am concerned that the salesperson that sold me the policy had no financial background and the policy was not sold in my best intrests.

    Unless you can satisfactorily justify to me that the policy was fair and reasonable i am requesting a full refund of all premiums and subsequent interesticon on these payments that i have paid to date. As i believe i have been deprived of this money i also expect 8% statutory interestthe amount a court would award to be added to each payment made.
    I look forward to a full and prompt response to this letter and for the matter to be concluded in eight weeks or i shall be contacting the financial Ombudsmanicon to investigate my complaint
    .


    To which they replied;

    Thank you for your letter concerning your ppi policy.

    We are keen to ensure all complaints are handled fairly and efficiently therefore we will be reviewing our own internal process and procedures.
    Unfortunately at this stage we dont feel we can accept your complaint as we do not have sufficient details form you. You can facilitate this by answering the questions on the attached sheet to the best of your ability. This will enable us to take full account of your exact complaint and your own recollections of the sale.
    When we recieve your information we will consider it in the light of our own evidence and we will let you know our final decision. If we believe there is any shortfall on our part we will consider how to recompense you.

    If you dont reply within one week of this letter, the 8 weeks allowed to us by the fsa rules to issue a final decision will be extended by the time it takes for you to reply.


    The questions:

    When did you first become aware you had a complaint?

    Where and / or how did you take out the ppi policy

    What do you remember from the time you took out the policy?

    What documentation were you given when you took the policy out?

    Please provide details of your job at the time you took out the policy and also details of any other ppi policies you have had in the past?

    Is there any information you wish to tell us about your complaint?


    Now i may be being a little daft but the answers to some of these questions were outlined in my letter.

    I need help with what to do next do i fill it in and return it? are they trying to catch me out or is this a standard thing to recieve? Also why would they be asking me about my job at the time when they have all this information already as seen by me on my SARicon and what right do they have to information about any other ppi policies i may have had?

    Anyones help in this matter would be gratefully appreciated.

    this is being asked by many the whole point is that mis-selling of PPI has only in the past 2 years become widely known about.

    Where and / or how did you take out the ppi policy

    You should refer them back to your sar request they should have all the relevant details on file.

    What do you remember from the time you took out the policy?

    You could ask them the same, what do they remember when they sold you the policy and did they fill in a needs and wants/customer duty of care questionnaire at the point of sale which they should have done to ensure the policy was suitable for you.

    What documentation were you given when you took the policy out?

    Again refer them to you Subject access requesticon they should have kept all the relevant documentation on your loan and you have paid for them to supply you with the information.

    Please provide details of your job at the time you took out the policy and also details of any other ppi policies you have had in the past?

    Again the details of your employment should have been discussed at the point of sale and they should have made notes and recorded the same for future reference should you have to claim.

    Details for any other PPI policies have nothing to do with welcome whatsoever unless they were with welcome and of course you would be claiming on them as well.

    Is there any information you wish to tell us about your complaint?

    Yes you are not happy with them questioning you when it is you sending the Subject access requesticon with a fee of £10.00

Questionnaires are allowed but financial institutions are using these as a ploy to see how much information you already have and as a delaying tactic. Remember you are doing the claiming. Also why would they be asking me about my job at the time when they have all this information already as seen by me on my Subject Access Request and what right do they have to information about any other ppi policies i may have had? again see my comments above.

    I hope my comments help. By all means help where you can but at the end of the day I would guess you will have no response within 8 weeks and the fosicon or Court will be your options. You should try and remain in the driving seat and make them do the research for documents and information on your data after all you have paid the statutory fee within the law of the Data Protection Act 1998.

    I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    ***RBS PPI Claim Long fight but, WON***

    Please do not PM me for advice as it may be sometime before I can respond.

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

    This is Welcome's standard response. I got this last week and I ripped up the questionnaire and sent another letter advising them that they should be aware of how and where it was purchased etc. I gave them a further 14 days to give a satisfactory response or I'll forward it to the fosicon.

    They have 7 days left
